【摘要】：碳貿(mào)易市場是使用經(jīng)濟(jì)手段和法律手段對碳排放權(quán)進(jìn)行初始分配,以應(yīng)對氣候變化,從而保障國家經(jīng)濟(jì)社會(huì)可持續(xù)、健康發(fā)展的綜合平臺(tái)。碳貿(mào)易是為促進(jìn)全球溫室氣體減排,減少全球二氧化碳排放采用的市場機(jī)制。國際碳貿(mào)易機(jī)制主要是以《聯(lián)合國氣候變化框架公約》和《京都議定書》等一系列國際法為基礎(chǔ)構(gòu)建的,但是碳貿(mào)易機(jī)制在中國的實(shí)踐,需要將國際碳貿(mào)易機(jī)制的共性與中國具體國情相結(jié)合,采取循序漸進(jìn)的方式逐步推進(jìn)碳貿(mào)易市場的建立,并由國內(nèi)法律規(guī)則予以保障。 為此,本文在國際法和國際碳排放交易機(jī)制的指導(dǎo)下,研究了中國碳貿(mào)易機(jī)制以及我國碳貿(mào)易市場建立中的法律問題。首先,本文在國際碳排放權(quán)交易機(jī)制和國際法的指導(dǎo)下,分析了我國碳貿(mào)易市場的發(fā)展現(xiàn)狀和存在的問題,并以國際碳貿(mào)易機(jī)制為基礎(chǔ),提出了一些建議和對策；然后,對中國碳貿(mào)易機(jī)制、碳貿(mào)易市場中的碳收支定量認(rèn)證體系以及碳貿(mào)易法律問題進(jìn)行了深入研究,為構(gòu)建實(shí)用性、可操作性的中國碳貿(mào)易市場機(jī)制提供了借鑒；最后,提出了具有中國特色的碳貿(mào)易法律對策,為保障中國碳貿(mào)易市場的正常運(yùn)行提供了法律保障。
[Abstract]:Carbon trading market is a comprehensive platform for the sustainable and healthy development of national economy and society through the initial allocation of carbon emission rights by means of economic means and legal means in order to cope with climate change and ensure the sustainable and healthy development of national economy and society. Carbon trading is a market mechanism to promote global greenhouse gas emission reduction and reduce global carbon dioxide emissions. The international carbon trading regime is mainly based on a series of international laws, such as the United Nations Framework Convention on Climate change and the Kyoto Protocol, but the practice of the carbon trading mechanism in China, It is necessary to combine the commonness of the international carbon trading mechanism with China's specific national conditions, to adopt a gradual and orderly way to promote the establishment of the carbon trading market, and to guarantee it by domestic laws and regulations. Therefore, under the guidance of international law and international carbon emissions trading mechanism, this paper studies China's carbon trading mechanism and the legal issues in the establishment of China's carbon trading market. Firstly, under the guidance of international carbon trading mechanism and international law, this paper analyzes the current situation and existing problems of China's carbon trading market, and puts forward some suggestions and countermeasures based on the international carbon trading mechanism. Then, the carbon trading mechanism of China, the carbon balance quantitative certification system in the carbon trading market and the legal issues of carbon trade are studied in depth, which provides a reference for the construction of practical and operational carbon trading market mechanism in China. Finally, the legal countermeasures of carbon trade with Chinese characteristics are put forward, which provide a legal guarantee for the normal operation of China's carbon trading market.
