【摘要】：由于各國對西北航道的權(quán)屬爭議日趨激烈,加拿大北極群島水域的法律地位也一再成為北極爭端中的國際熱點(diǎn)。在這樣的國際背景之下,美加等國圍繞北極群島水域是否屬于加國的歷史性內(nèi)水提出各自的官方主張。根據(jù)理論上對歷史性水域法律地位和成立標(biāo)準(zhǔn)的界定,綜合考慮美加兩國立場,通過對歷史性水域理論在北極群島水域的適用分析可知,將北極群島水域看作是加國的歷史性內(nèi)水具有一定的理論基礎(chǔ)和實(shí)際意義。
[Abstract]:The legal status of Canadian arctic archipelago has become an international hot spot in the Arctic dispute because of the increasingly fierce disputes over the ownership of the Northwest Waterway. In this international context, the United States and Canada put forward their own official claims about whether Arctic archipelago waters belong to Canada's historic internal waters. According to the theoretical definition of the legal status and establishment criteria of historic waters, considering the positions of the United States and Canada comprehensively, through the analysis of the application of historical waters theory in Arctic archipelago waters, It is of theoretical and practical significance to regard Arctic archipelago waters as the historic internal water of Canada.
