【摘要】：防空識別區(qū)是各國在鄰接領(lǐng)空的空域設(shè)置的、對他國航空器進(jìn)行識別以實現(xiàn)空中預(yù)警并維護(hù)國家安全的一項制度,其本身是國際社會猶存已久的現(xiàn)象。我國于2013年劃設(shè)東海防空識別區(qū)引起了國際社會的廣泛關(guān)注。本文從防空識別區(qū)制度的一般性理論著手,結(jié)合國際社會具有代表性的國家實踐,通過歷史分析法、文獻(xiàn)分析法和對比分析法等多種途徑對該制度進(jìn)行分析,并得出以下結(jié)論：專屬經(jīng)濟(jì)區(qū)空域剩余權(quán)利是防空識別區(qū)制度的最佳研究視角,它為制度提供了國內(nèi)立法的完善方向以及發(fā)展為國際空間法的理論依據(jù)。文章共分為四個部分：從第一部分防空識別區(qū)的概念和相關(guān)領(lǐng)域的辨析等一般性理論出發(fā),第二部分重點分析各國在該領(lǐng)域的實踐以及國際社會關(guān)于防空識別區(qū)的觀點,第三部分總結(jié)對防空識別區(qū)制度的發(fā)展具有指導(dǎo)作用的專屬經(jīng)濟(jì)區(qū)空域剩余權(quán)利的最新趨勢,最后第四部分通過分析得出完善防空識別區(qū)制度的合理而具有創(chuàng)新性的建議。各章節(jié)以發(fā)現(xiàn)問題、分析問題、解決問題的思路,闡釋了防空識別區(qū)制度現(xiàn)有的一些問題,并在結(jié)尾為防空識別區(qū)的完善提出了參考性意見。
[Abstract]:Air Defense Identification Zone (ADIZ) is a system that all countries set up in the airspace adjacent to the airspace to identify the aircraft of other countries in order to realize air warning and maintain national security. It is a long-standing phenomenon in the international community itself. The establishment of the East China Sea Air Defense Identification Zone (ADIZ) in 2013 has attracted wide attention of the international community. Starting from the general theory of the air defense identification zone system and combining with the representative national practice of the international community, this paper analyzes the air defense identification zone system by means of historical analysis, literature analysis and comparative analysis, and so on. And draw the following conclusion: exclusive economic zone airspace surplus right is the best research perspective of the air defense identification zone system, which provides the perfect direction of domestic legislation and the theoretical basis for the development of international space law. The article is divided into four parts: from the first part of the concept of air defense identification zone and related areas of discrimination and other general theory, the second part focuses on the analysis of the practice of countries in this field and the international community on air defense identification zone point of view, The third part summarizes the latest trend of airspace residual rights of exclusive economic zone, which plays a guiding role in the development of air defense identification zone system. Finally, through the analysis of the fourth part, the reasonable and innovative suggestions to improve the air defense identification zone system are obtained. In order to find the problem, analyze the problem and solve the problem, each chapter explains some problems existing in the air defense identification zone system, and puts forward some reference suggestions for the improvement of the air defense identification zone at the end of the chapter.
