國際貿(mào)易中藍色壁壘法律分析

【摘要】：隨著國際貿(mào)易不斷深入競爭越來越激烈，傳統(tǒng)的貿(mào)易壁壘成為一國保護性貿(mào)易壁壘的可能性也越來越低，藍色壁壘作為一種新型的貿(mào)易壁壘它所具有的社會特性和經(jīng)濟特性備受發(fā)達國家青睞，成為發(fā)達國家對發(fā)展中國家實行貿(mào)易保護措施的手段。我國作為勞動密集型產(chǎn)業(yè)的主要出口大國，必須討論和面對藍色壁壘的問題。本文通過對國際社會對藍色貿(mào)易壁壘的立法和多邊貿(mào)易體制與國際勞工標準的法律關(guān)系進行探討，運用文獻分析法、實證分析法、比較分析法和歷史分析法等方法，意圖尋找出在多邊貿(mào)易體制的法律框架下能有效保護勞工權(quán)益和應對藍色壁壘的方式。本文在研究的基礎上提出了在國際貿(mào)易組織體系下與國際勞工組織的合作能夠成為保護勞工權(quán)益的方式，也將有助于發(fā)展中國家應對藍色壁壘。同時在對我國遭遇藍色壁壘的現(xiàn)狀進行分析后，從立法和企業(yè)兩方面提出建議，，期望能更加積極的面對藍色壁壘問題。
[Abstract]:With the continuous deepening of international trade competition, the possibility of traditional trade barriers becoming protective barriers to trade in a country is becoming less and less likely. As a new type of trade barrier, blue barrier has been favored by developed countries for its social and economic characteristics, and has become a means of implementing trade protection measures against developing countries by developed countries. As a major exporter of labor-intensive industries, China must discuss and face the blue barriers. This paper probes into the legislation of blue trade barriers and the legal relationship between multilateral trading system and international labor standards, using the methods of literature analysis, empirical analysis, comparative analysis and historical analysis, etc. The intention is to find ways to effectively protect labor rights and deal with blue barriers within the legal framework of the multilateral trading system. On the basis of the research, this paper puts forward that the cooperation with the International Labour Organization under the system of the International Trade Organization can be a way to protect the labor rights and interests, and will be helpful for developing countries to cope with the blue barriers. At the same time, after analyzing the present situation of blue barrier in our country, this paper puts forward some suggestions from the aspects of legislation and enterprise, and hopes to face the blue barrier problem more actively.
