二戰(zhàn)流失文物回歸爭端解決的最新進展及其法律評析

【摘要】：二戰(zhàn)流失文物回歸爭端由來已久,且付諸法律解決存在著局限性,需采取法律以外的方式加以解決,為此,聯(lián)合國教科文組織《關(guān)于第二次世界大戰(zhàn)流失文物的原則宣言草案》為促進各國締結(jié)文物回歸協(xié)議提出了具有普遍指導(dǎo)意義的原則,它在依據(jù)國際法關(guān)于戰(zhàn)爭時期采取公法方式解決文物回歸問題的法理的基礎(chǔ)上,提出有關(guān)國家應(yīng)促使文物回歸、文物回歸不受時效限制以及文物不得作為戰(zhàn)爭賠償?shù)仍瓌t,同時取消了對遺失或損毀的文物進行賠償?shù)脑瓌t,它實質(zhì)上是國際社會對二戰(zhàn)流失文物回歸爭端所引發(fā)的法律和道德原則進行深入思考而得到的成果,對于促進我國二戰(zhàn)流失文物問題的解決具有積極的意義。
[Abstract]:The dispute over the return of lost cultural relics to World War II has a long history, and there are limitations in its application to the law, which needs to be resolved by means other than the law. The United Nations Educational, Scientific and Cultural Organization (UNESCO) draft Declaration of principles relating to the loss of Antiquities from the second World War sets out universal guiding principles for promoting the conclusion of agreements on the return of cultural objects by States, On the basis of the jurisprudence of international law on adopting public law to solve the problem of the return of cultural relics in times of war, it puts forward the principles that the countries concerned should promote the return of cultural relics, that the return of cultural relics should not be restricted by statute of limitations and that cultural relics may not be used as war compensation. At the same time, the principle of compensation for lost or damaged cultural relics was abolished. In essence, it was the result of the international community's in-depth reflection on the legal and moral principles arising from the dispute over the return of lost relics to World War II. It is of positive significance to promote the solution of the problem of lost cultural relics in World War II in China.
