【摘要】：IPCC的1990年"評估報告"指出,人類活動產(chǎn)生的各種排放正在使大氣中溫室氣體濃度顯著增加;在人類活動排放大氣層中的全部CO2中,燃燒礦物燃料占70%~90%,其余10%~30%則是人類對地球生態(tài)系統(tǒng)的利用所致。氣候變化正不斷吞噬人類生存空間,威脅人類的生存與發(fā)展,引發(fā)了國際關(guān)系的變動和國際秩序的革新。20世紀(jì)90年代后,以《聯(lián)合國氣候變化框架公約》為標(biāo)志,國際法領(lǐng)域逐漸形成國際氣候變化法這一新興的國際法律部門,這是晚近國際法發(fā)展的一大突破。國際氣候變化法的生成是內(nèi)外因素共同作用的結(jié)果,氣候變化科學(xué)認(rèn)知、國際氣候政治共識、國際氣候合作和國際氣候合作關(guān)系分別構(gòu)成國際氣候變化法生成的科學(xué)、政治、現(xiàn)實和法理基礎(chǔ),國際組織的推動和國內(nèi)相關(guān)立法的影響構(gòu)成國際氣候變化法生成的重要外部因素。
[Abstract]:IPCC's 1990 Assessment report notes that anthropogenic emissions are leading to significant increases in greenhouse gas concentrations in the atmosphere; Of the total CO2 emitted from the atmosphere by human activities, the burning of fossil fuel accounts for 7090%, and the remaining 10% is due to the utilization of the Earth's ecosystem by human beings. Climate change is incessantly devouring the living space of mankind, threatening the survival and development of mankind, causing changes in international relations and innovation in the international order. Since the 1990s, it has been marked by the United Nations Framework Convention on Climate change. International climate change law, a new international legal department, has gradually formed in the field of international law, which is a breakthrough in the recent development of international law. The formation of international climate change law is the result of the joint action of internal and external factors. The scientific cognition of climate change, the international climate political consensus, the international climate cooperation and the international climate cooperation relationship constitute the science and politics of international climate change law respectively. The basis of reality and jurisprudence, the promotion of international organizations and the influence of relevant domestic legislation constitute the important external factors for the generation of international climate change law.
