【摘要】：外大陸架即200海里外大陸架,是根據(jù)1982年《聯(lián)合國(guó)海洋法公約》建立的國(guó)際法律制度而誕生的海洋區(qū)域。是沿海國(guó)大陸向海洋自然延伸從領(lǐng)海基線量起超過200海里而不超過350海里,或不超過連接2500公尺深度各點(diǎn)的2500公尺等深線100海里的部分。 大陸架界限委員會(huì)(CLCS)是根據(jù)《聯(lián)合國(guó)海洋法公約》而成立的國(guó)際組織,負(fù)責(zé)審議沿海國(guó)家提交的外大陸架劃界案并給出建議。沿海國(guó)在此建議的基礎(chǔ)上劃定的大陸架外部界限具有確定性和約束力。 根據(jù)《聯(lián)合國(guó)海洋法公約》的規(guī)定及《聯(lián)合國(guó)海洋法公約》第18次締約國(guó)會(huì)議的規(guī)定,沿海國(guó)須在2009年5月13日前提交外大陸架劃界案或初步信息,這使得我周邊國(guó)家紛紛向大陸架界限委員會(huì)提交劃界案或初步信息,2009年5月11日,我國(guó)也向大陸架界限委員會(huì)提交了我國(guó)外大陸架初步信息。 本文擬對(duì)這些申請(qǐng)案提交的背景、動(dòng)機(jī)、內(nèi)容及相關(guān)國(guó)家的反對(duì)意見、大陸架界限委員會(huì)的審理情況進(jìn)行闡述分析,在此基礎(chǔ)上探討中國(guó)該如何應(yīng)對(duì)這次申請(qǐng)案所帶來的挑戰(zhàn)以及如何維護(hù)我海洋權(quán)益。
[Abstract]:The outer continental shelf is the outer continental shelf of 200 nautical miles. It is a maritime area which was established according to the international legal system established by the 1982 United Nations Convention on the Law of the Sea. A part of a coastal state that naturally extends towards the ocean, measuring more than 200 nautical miles from the baselines of the territorial sea and not exceeding 350 nautical miles, or not exceeding the 2500 m isobath of 2500 m deep points. The Commission on the limits of the Continental Shelf (CLCS) is an international organization established under the United Nations Convention on the Law of the Sea to consider and make recommendations on submissions made by coastal States to the outer continental shelf. The outer limits of the continental shelf established by coastal States on the basis of this recommendation are deterministic and binding. In accordance with the provisions of the United Nations Convention on the Law of the Sea and the provisions of the eighteenth meeting of States parties to the United Nations Convention on the Law of the Sea, coastal States are required to submit their submissions or preliminary information on the outer continental shelf by 13 May 2009, This has led our neighboring countries to submit submissions or preliminary information to the Commission on the limits of the Continental Shelf. On 11 May 2009, China also submitted its preliminary information on the outer continental shelf to the Commission on the limits of the Continental Shelf. This paper intends to elaborate and analyse the background, motive, content and objections of the States concerned, as well as the proceedings of the Commission on the limits of the Continental Shelf, On this basis, this paper discusses how China should deal with the challenges of this application and how to protect our maritime rights and interests.
