【摘要】：俄羅斯主導(dǎo)的歐亞經(jīng)濟(jì)聯(lián)盟的成立對后蘇聯(lián)空間的區(qū)域經(jīng)濟(jì)一體化乃至世界政治經(jīng)濟(jì)格局產(chǎn)生了重要的影響。歐亞經(jīng)濟(jì)聯(lián)盟最大的功績在于建立起統(tǒng)一的法律機(jī)制。本文以國際組織法為研究視角,探討歐亞經(jīng)濟(jì)聯(lián)盟法律制度的憲法性基礎(chǔ)�；诖�,對歐亞經(jīng)濟(jì)聯(lián)盟與歐盟之間進(jìn)行分析和比較研究,從而形成對聯(lián)盟法律制度基本的認(rèn)識,由此闡述歐亞經(jīng)濟(jì)聯(lián)盟法律制度建立對絲綢之路經(jīng)濟(jì)帶建設(shè)的影響及應(yīng)對。首先,探討了歐亞經(jīng)濟(jì)聯(lián)盟的發(fā)展?fàn)顩r、組織的歷史沿革以及國際法律人格。在此基礎(chǔ)上,對歐亞經(jīng)濟(jì)聯(lián)盟法律法律秩序,從法律淵源與法律原則、組織機(jī)構(gòu)、決策機(jī)制、聯(lián)盟法與成員國法的關(guān)系等方面進(jìn)行分析,從而得出結(jié)論:歐亞經(jīng)濟(jì)聯(lián)盟法律制度具有鮮明的歐亞地區(qū)特色,更多遵循政府間主義而非功能主義。從法律模式和組織功能兩方面,對歐亞經(jīng)濟(jì)聯(lián)盟與歐盟法律制度之間做出比較分析,并得出結(jié)論:歐亞經(jīng)濟(jì)聯(lián)盟具有高度形式化的特點(diǎn),是對歐盟模式浮于表面的效仿,一體化深度和廣度皆弱于歐盟。由于受到制度失效危機(jī)、法律制度局限性、烏克蘭危機(jī)和俄羅斯經(jīng)濟(jì)危機(jī)的影響,歐亞經(jīng)濟(jì)聯(lián)盟法律制度的未來發(fā)展呈現(xiàn)高度的不確定性。歐亞經(jīng)濟(jì)聯(lián)盟法律制度是脆弱而有限的,并未有效地將成員的行動納入法律體系加以規(guī)制,是典型的發(fā)展中國家區(qū)域一體化法律機(jī)制。由于歐亞經(jīng)濟(jì)聯(lián)盟法律制度的建立對絲綢之路經(jīng)濟(jì)帶建設(shè)產(chǎn)生了積極和消極兩方面影響,因此需要從構(gòu)建對接合作法律文化和完善制度與規(guī)則層面對接兩方面實(shí)現(xiàn)絲綢之路經(jīng)濟(jì)帶與歐亞經(jīng)濟(jì)聯(lián)盟的對接合作。
[Abstract]:The establishment of the Russian-led Eurasian Economic Union has had an important impact on the regional economic integration in the space of the post-Soviet Union and on the world political and economic pattern. The Eurasian Economic Union's greatest merit lies in the establishment of a unified legal mechanism. This paper discusses the constitutional basis of Eurasian Economic Union (Eurasian Economic Union) from the perspective of international organic law. Based on this, this paper analyzes and compares the Eurasian Economic Union (Eurasian Economic Union) and the European Union (EU) in order to form a basic understanding of the Union's legal system, and then expounds the influence and countermeasures of the establishment of the Eurasian Economic Union's legal system on the construction of the Silk Road economic belt. First, it discusses the development of Eurasian Economic Union, the history of the organization and international legal personality. On this basis, the legal order of Eurasian Economic Union (Eurasian Economic Union) is analyzed from the aspects of legal origin and legal principles, organization and organization, decision-making mechanism, the relationship between union law and the law of member states, etc. The conclusion is that the legal system of Eurasian Economic Union (Eurasian Economic Union) has distinct Eurasian characteristics and follows more intergovernmental than functionalism. This paper makes a comparative analysis of the legal system between the Eurasian Economic Union and the European Union from the two aspects of the legal model and the organizational function, and draws a conclusion that the Eurasian Economic Union has a highly formalized characteristic and is a superficial emulation of the European Union model. Integration is weaker in depth and breadth than in the EU. The future development of Eurasian Economic Union (Eurasian Economic Union) is highly uncertain due to the crisis of institutional invalidation, the limitation of legal system, the crisis of Ukraine and the economic crisis of Russia. The Eurasian Economic Union (Eurasian Economic Union) is a typical legal mechanism of regional integration in developing countries because its legal system is fragile and limited and does not effectively regulate the actions of its members. Since the establishment of the legal system of the Eurasian Economic Union has had a positive and negative impact on the construction of the Silk Road economic belt, Therefore, it is necessary to realize the docking cooperation between the Silk Road Economic Belt and the Eurasian Economic Union from the aspects of constructing the docking legal culture and perfecting the system and rules.
