【摘要】：隨著網(wǎng)絡(luò)科技的急速發(fā)展、普及和應(yīng)用,網(wǎng)絡(luò)生活正日益占據(jù)人類世界生活的方方面面,伴隨而來的網(wǎng)絡(luò)安全問題也日益威脅著全球化進程中各國的和平與穩(wěn)定。面對網(wǎng)絡(luò)空間的特殊屬性,當前國際法學界對網(wǎng)絡(luò)安全問題的爭論集中點在于,是在現(xiàn)有的國際法框架內(nèi)尋求規(guī)則對網(wǎng)絡(luò)空間進行治理,還是創(chuàng)制新的國際法規(guī)則�！端质謨浴贰斀駠H社會首次從現(xiàn)有國際法框架內(nèi)尋求對網(wǎng)絡(luò)攻擊問題進行規(guī)制的研究成果——給這個爭論作出了回應(yīng)�！端质謨浴吩噲D將網(wǎng)絡(luò)攻擊行為納入到“武力使用”的范疇內(nèi)規(guī)制,認為一項網(wǎng)絡(luò)攻擊行為一旦符合“規(guī)模和后果”要素便可構(gòu)成“武力使用”,這無論是在法理上還是實踐上,都有著一定的疑點,邏輯上也有待考察。本文將嘗試客觀、科學地分析《塔林手冊》是如何界定網(wǎng)絡(luò)攻擊構(gòu)成“武力使用”的,又是如何界定“武力使用”的。本文還將考察現(xiàn)行國際法對“武力使用”這一范疇的界定。這項考察將涉及到《聯(lián)合國憲章》第2條第4款關(guān)于禁止使用武力或武力威脅的規(guī)定。雖然《塔林手冊》將網(wǎng)絡(luò)攻擊行為納入到“武力使用”范疇內(nèi)規(guī)制的意圖存在某種利益化傾向,但該角度或為研究網(wǎng)絡(luò)攻擊的規(guī)制提供了新的思路與方法。因此,《塔林手冊》對有志于研究網(wǎng)絡(luò)空間安全問題的人來講是一份珍貴的材料,值得對其作更深入的研究。
[Abstract]:With the rapid development, popularization and application of network technology, network life is increasingly occupying all aspects of human world life, and the accompanying network security issues are increasingly threatening the peace and stability of countries in the process of globalization. In the face of the special property of cyberspace, the focal point of the current international legal debate on cybersecurity is to seek rules to govern cyberspace within the existing framework of international law. Or the creation of new rules of international law. The Tallinn Manual, the first time the international community has sought to regulate cyberattacks within the existing framework of international law, responds to this debate. The Forest Manual attempts to include cyber-attacks in the context of "use of force". It is considered that once an act of network attack conforms to the elements of "scale and consequence", it can constitute "use of force", which has certain doubts in legal theory and practice, and needs to be investigated logically. This paper will try to analyze objectively and scientifically how the Tallinn Manual defines the "use of force" and how the "use of force" is constituted by the network attack. This paper will also examine the definition of "use of force" in current international law. The study would involve Article 2, paragraph 4, of the Charter of the United Nations on the prohibition of the use or threat of use of force. Although there is a tendency of interest in the intention of bringing network attack into the category of "use of force" in the Tallinn Manual, it may provide a new way of thinking and method for the study of the regulation of network attack. Therefore, the Tallinn Manual is a valuable material for those who are interested in studying the problem of cyberspace security, and it is worthy of further study.
