論世界貿(mào)易組織反傾銷產(chǎn)業(yè)損害確定的若干法律問題

【摘要】:反傾銷制度是世界貿(mào)易組織認(rèn)可并許可使用的貿(mào)易保護(hù)措施之一,因其啟動簡便、作用有效、直接且隱蔽的特點(diǎn),日益得到各成員方的普遍重視和頻繁援用。反傾銷制度的目的在于抵制對進(jìn)口方國內(nèi)產(chǎn)業(yè)造成損害的傾銷,而非普遍地打擊傾銷本身。反傾銷措施的啟動須以調(diào)查機(jī)關(guān)對傾銷進(jìn)口產(chǎn)品致使國內(nèi)產(chǎn)業(yè)遭受損害的肯定性結(jié)論為前提。因此,產(chǎn)業(yè)損害確定的相關(guān)問題在反傾銷調(diào)查中意義重大,它不僅是調(diào)查的核心內(nèi)容,更是限制反傾銷措施濫用的重要環(huán)節(jié)。 中國作為WTO成員方,反傾銷立法及實(shí)踐均須符合WTO規(guī)則。為此目的,制度上明確《反傾銷協(xié)定》第3條“損害確定”的含義是充分運(yùn)用國際規(guī)則的前提。調(diào)查機(jī)關(guān)對事實(shí)、數(shù)據(jù)的深入挖掘與審慎分析則是規(guī)則得以適用的必要條件,也是合理利用國際反傾銷法律制度,維護(hù)進(jìn)口國產(chǎn)業(yè)良好發(fā)展環(huán)境、合法利益及全球公平貿(mào)易秩序的重要環(huán)節(jié)。 本文立足WTO《反傾銷協(xié)定》現(xiàn)有規(guī)則的合理性及通行解釋,以求對《反傾銷協(xié)定》規(guī)則中的模糊與不確定性之處加以明晰。文章亦將從實(shí)踐的視角和操作的層面關(guān)注和討論如何描述、體現(xiàn)傾銷損害,,以得到爭端解決機(jī)構(gòu)的采納與認(rèn)可。并在此基礎(chǔ)上結(jié)合中國的反傾銷立法和實(shí)踐,對有關(guān)問題提出改進(jìn)的參考方案。 本文的論述邏輯如下: 第一章介紹傾銷、反傾銷的含義、特征;產(chǎn)業(yè)損害確定的概要內(nèi)容,及其在反傾銷中的制度價值,為后文的展開提供框架。 第二章通過分析同類產(chǎn)品與國內(nèi)產(chǎn)業(yè)來構(gòu)建產(chǎn)業(yè)損害對象的確立標(biāo)準(zhǔn)。 第三章在總結(jié)WTO爭端解決機(jī)制及成員方實(shí)踐的基礎(chǔ)上,對產(chǎn)業(yè)損害審查(包括實(shí)質(zhì)損害、實(shí)質(zhì)損害威脅和實(shí)質(zhì)阻礙)的具體因素和要求進(jìn)行解釋和明確,并探討了累積評估的適用。 第四章通過比較WTO框架下規(guī)則標(biāo)準(zhǔn)的變遷及中國實(shí)踐經(jīng)驗(yàn),探討了傾銷進(jìn)口產(chǎn)品與國內(nèi)產(chǎn)業(yè)損害間因果關(guān)系程度及真實(shí)性的標(biāo)準(zhǔn)問題,并討論了中國運(yùn)用策略上的轉(zhuǎn)變。 第五章以歐盟的實(shí)踐為例,對計(jì)算方法進(jìn)行了簡要介紹,并探討中國采納適用的可能性及步驟問題。 結(jié)論部分提出了多邊談判對WTO反傾銷制度產(chǎn)業(yè)損害確定規(guī)則與落實(shí)的一些阻礙;并總結(jié)了各章關(guān)于中國立法和實(shí)踐完善的要點(diǎn)。
[Abstract]:Anti-dumping system is one of the trade protection measures approved and permitted by the World Trade Organization. Because of its simple, effective, direct and hidden characteristics, anti-dumping system has been paid more and more attention to and frequently invoked by all members. The purpose of anti-dumping system is to resist dumping which causes harm to the importer's domestic industry, rather than to attack dumping itself. The initiation of anti-dumping measures must be based on the positive conclusion that the domestic industry is injured by dumping imported products. Therefore, the problems related to the determination of industrial damage are of great significance in the anti-dumping investigation, which is not only the core content of the investigation, but also an important link to limit the abuse of anti-dumping measures. As a member of WTO, China's anti-dumping legislation and practice must conform to the WTO rules. To this end, the institutional clarification of the meaning of "damage determination" in Article 3 of the Anti-dumping Agreement is a prerequisite for the full application of international rules. The thorough excavation and careful analysis of the facts and data by the investigating organs are the necessary conditions for the application of the rules, and are also necessary for the rational use of the international anti-dumping legal system and for the maintenance of a sound environment for the development of industries in importing countries. This paper is based on the rationality and general interpretation of the existing rules of the WTO Anti-dumping Agreement in order to clarify the ambiguity and uncertainty in the rules of the Anti-dumping Agreement. The article will also focus on and discuss how to describe dumping injury from the perspective of practice and operation, so as to obtain the adoption and approval of the dispute settlement body. On the basis of this, combined with China's anti-dumping legislation and practice, this paper puts forward some suggestions for improving the relevant issues. The logic of this paper is as follows: the first chapter introduces the meaning and characteristics of dumping, anti-dumping, the summary content of industrial injury determination and its institutional value in antidumping, which provides a framework for the later part. The second chapter constructs the establishment standard of industry damage object by analyzing the similar products and domestic industries. On the basis of summing up the WTO dispute settlement mechanism and the member parties' practice, the third chapter explains and clarifies the specific factors and requirements of the industrial damage examination (including substantial damage, material damage threat and material hindrance). The application of cumulative assessment is discussed. By comparing the changes of rules and standards under the framework of WTO and China's practical experience, the fourth chapter discusses the standard of causality and authenticity between dumped imported products and domestic industrial injury, and discusses the transformation of China's application strategy. In chapter 5, taking the practice of European Union as an example, the calculation method is briefly introduced, and the possibility and steps of China's adoption are discussed. In the conclusion part, the author puts forward some obstacles to the establishment and implementation of the rules of multilateral negotiation on the industrial damage of WTO anti-dumping system, and summarizes the key points of the perfection of China's legislation and practice in each chapter.
