【摘要】：森林覆蓋了歐盟領(lǐng)土的大部分區(qū)域，其所體現(xiàn)的多功能性和生態(tài)價值顯得格外關(guān)鍵，歐盟森林生態(tài)補償制度作為歐洲共同農(nóng)業(yè)和農(nóng)村發(fā)展政策的重要組成部分，其目的在于給予提供森林生態(tài)服務(wù)和產(chǎn)品的林農(nóng)支持，服務(wù)于林地環(huán)境的保護，從而以促進歐洲共同農(nóng)業(yè)和農(nóng)村的可持續(xù)發(fā)展。研究歐盟森林生態(tài)補償制度的產(chǎn)生和發(fā)展，探討其在實施過程中的經(jīng)驗，有利于我們深化對森林生態(tài)補償制度的認識，為我國森林生態(tài)補償制度的確立和應(yīng)用提供借鑒。 本文首先在歐盟森林戰(zhàn)略和歐盟森林行動計劃框架下為“森林生態(tài)補償制度”下了定義，并通過比較研究方法分析了歐盟森林生態(tài)補償制度的理論與價值基礎(chǔ)，并在其中納入了與森林生態(tài)補償密切相關(guān)的其他農(nóng)業(yè)環(huán)境措施的內(nèi)容。其次，歸納總結(jié)了歐盟森林生態(tài)補償制度的歷史沿革和演進過程，敘述了制度構(gòu)建所涵蓋的主要內(nèi)容。最后，本文深入分析了歐盟森林生態(tài)補償制度的目標、任務(wù)以及具體實施的情況，總結(jié)了森林生態(tài)補償制度對歐盟環(huán)境保護和經(jīng)濟發(fā)展的影響。 通過以上研究分析，本文總結(jié)出了相關(guān)的結(jié)論。第一，歐盟森林生態(tài)補償制度蘊含著深厚的可持續(xù)發(fā)展理念基礎(chǔ)；第二，歐盟森林生態(tài)補償制度體現(xiàn)了高度的環(huán)境公平正義；第三，歐盟森林生態(tài)補償制度擁有其特有的任務(wù)、目標和實施措施，并在發(fā)展中不斷的改進和完善；第四，歐盟森林生態(tài)補償制度取得了顯著的成功，有效的解決了經(jīng)濟發(fā)展和環(huán)境保護的博弈問題，并從整體上推動了歐洲共同農(nóng)業(yè)和農(nóng)村發(fā)展政策開展與落實。 本文在對歐盟森林生態(tài)補償制度進行研究分析的基礎(chǔ)上，提出了我國在森林生態(tài)補償制度構(gòu)建的過程中所應(yīng)借鑒的相關(guān)經(jīng)驗。并且強調(diào)我國在環(huán)境法治建設(shè)中，借鑒國外先進經(jīng)驗要進行理性和深入的分析與研究，討論國外政策法規(guī)制定和實施的合理性，，并探討相關(guān)環(huán)境法律制度在實施過程中的問題。 最后，本文認為我國應(yīng)當充分認識到森林生態(tài)補償制度在整個環(huán)境法治體系中的重要性，進一步加大對森林生態(tài)資源的保護，以促進經(jīng)濟發(fā)展和環(huán)境保護這個博弈問題的有效解決，確保森林生態(tài)價值真實體現(xiàn)并充分發(fā)揮森林的多功能性效用。
[Abstract]:Forests cover most of the territory of the European Union, and their multifunctional and ecological values are particularly critical. The European Union's forest ecological compensation system is an important part of the European Common Agricultural and Rural Development Policy. The aim is to support the forest farmers who provide forest ecological services and products to protect the forestland environment so as to promote the sustainable development of common agriculture and rural areas in Europe. It is helpful for us to deepen our understanding of forest ecological compensation system and to provide reference for the establishment and application of forest ecological compensation system in our country by studying the emergence and development of forest ecological compensation system in EU and discussing its experience in the process of implementation. This paper firstly defines the forest ecological compensation system under the framework of the EU Forest Strategy and the EU Forest Action Plan, and analyzes the theoretical and value basis of the EU Forest Ecological compensation system by means of comparative research methods. And include other agricultural environmental measures closely related to forest ecological compensation. Secondly, the history and evolution of the forest ecological compensation system in EU are summarized, and the main contents of the system construction are described. Finally, this paper analyzes the objectives, tasks and implementation of the forest ecological compensation system in the European Union, and summarizes the impact of the forest ecological compensation system on the environmental protection and economic development of the European Union. Through the above research and analysis, this paper summarizes the relevant conclusions. First, the forest ecological compensation system of the EU contains a deep foundation of the concept of sustainable development, second, the EU forest ecological compensation system embodies a high degree of environmental equity and justice. Third, the EU forest ecological compensation system has its unique tasks, objectives and implementation measures, and in the development of continuous improvement and improvement; Fourthly, the forest ecological compensation system of EU has achieved remarkable success, which has effectively solved the game problem of economic development and environmental protection, and has promoted the development and implementation of the common agricultural and rural development policy in Europe as a whole. Based on the research and analysis of the forest ecological compensation system in EU, this paper puts forward the relevant experiences that should be used for reference in the process of constructing the forest ecological compensation system in China. It is also emphasized that in the construction of environmental rule by law, we should make rational and in-depth analysis and research for reference from foreign advanced experience, discuss the rationality of the formulation and implementation of foreign policies and regulations, and discuss the problems in the implementation of relevant environmental legal systems. Finally, this paper holds that our country should fully realize the importance of forest ecological compensation system in the whole environmental legal system, and further strengthen the protection of forest ecological resources. In order to promote the economic development and environmental protection of the effective solution of the game to ensure that the forest ecological value truly reflect and give full play to the multifunctional utility of forest.
