【摘要】：深海海底所蘊(yùn)藏的巨大的資源成為人類(lèi)下一步所勘探和開(kāi)發(fā)的對(duì)象,為了規(guī)范人類(lèi)在"區(qū)域"的活動(dòng),《聯(lián)合國(guó)海洋法公約》第十一部分確立了多項(xiàng)法律制度,國(guó)家擔(dān)保制度是其中最重要的制度之一。中國(guó)作為《公約》締約國(guó)和國(guó)際海底區(qū)域開(kāi)發(fā)的先驅(qū)國(guó)家,于2016年2月26日通過(guò)《中華人民共和國(guó)深海海底區(qū)域資源勘探開(kāi)發(fā)法》,雖然該法沒(méi)有明確規(guī)定國(guó)家擔(dān)保制度,但是我國(guó)的法人或者自然人若從事深�；顒�(dòng),必須要獲得我國(guó)的擔(dān)保,并向國(guó)際海底管理局提交國(guó)家擔(dān)保證書(shū)以及其他相關(guān)材料,通過(guò)管理局審核,再同其簽訂深海海底資源的勘探和開(kāi)發(fā)合同。具體制度的設(shè)計(jì)應(yīng)與環(huán)境保護(hù)制度、許可制度相結(jié)合適用。
[Abstract]:The vast resources contained in the deep seabed have been the object of further exploration and exploitation by mankind and, in order to regulate the activities of mankind in the area, part XI of the United Nations Convention on the Law of the Sea has established a number of legal regimes, The national guarantee system is one of the most important systems. As a State party to the Convention and a pioneer State in the exploitation of the international seabed area, China adopted the Law of the people's Republic of China on Exploration and Exploitation of the Resources of the Deep seabed area on 26 February 2016, although the law does not explicitly provide for a national guarantee system, However, if a legal person or natural person of our country is engaged in deep-sea activities, he must obtain a guarantee from China and submit to the International seabed Authority a national guarantee certificate and other relevant materials for examination and approval by the Authority. The contract for exploration and exploitation of deep seabed resources shall be signed with him. The design of the specific system should be combined with the environmental protection system and the licensing system.
