【摘要】：人口、資源、環(huán)境一直是人類生存與發(fā)展所面臨的主要問題,受人口劇增、氣候變暖、水資源短缺等不利因素影響,僅靠傳統(tǒng)耕種方式提高糧食產(chǎn)量的可能性已十分有限,轉基因生物技術的運應而生成為解決這些問題的重要途徑。從1983年轉基因煙草誕生,轉基因技術不斷向農(nóng)業(yè)領域快速滲透和發(fā)展,到2014年全球轉基因作物面積已達1.815億公頃,2015全球轉基因作物種植面積首次下降,較上年減少1%,轉基因食品已經(jīng)成為21世紀的新型食品端上尋常百姓餐桌。可以說轉基因食品的出現(xiàn),是食品領域的一場革命。轉基因食品的發(fā)展為人類社會帶來巨大經(jīng)濟、社會效益,但是本身具有科學上的復雜性和不確定性,可能對人類健康和生態(tài)環(huán)境具有潛在風險和危害,因此轉基因食品安全成為全球各界廣泛關注和爭論的焦點。轉基因食品安全問題關系到大眾切身利益和國家經(jīng)濟利益,對其加強安全監(jiān)管立法,勢必成為各國題中之義。因此,世界各國立足于國家利益,基于各自立法原則,實行不同的轉基因食品安全監(jiān)管制度和模式,其中最具有代表性的是歐盟、美國和日本。本文第一部分闡述了轉基因食品安全監(jiān)管的基本概況,第二部分介紹分析了歐盟、美國、日本和國際組織轉基因食品安全監(jiān)管立法體系,進行比較和研究,總結其規(guī)律和經(jīng)驗。第三部分闡述了我國轉基因食品安全監(jiān)管立法現(xiàn)狀,指出我國轉基因食品安全監(jiān)管立法的諸多缺陷和問題。進而第四部分提出,面對轉基因食品我國應持謹慎樂觀的態(tài)度,堅持創(chuàng)新、協(xié)調(diào)、綠色、開放、共享發(fā)展理念,明確立法原則,引入“互聯(lián)網(wǎng)+”思維,對構建一套行之有效的法律體系和監(jiān)管制度確保實現(xiàn)對轉基因食品安全監(jiān)管提出建議和對策。
[Abstract]:Population, resources and environment have always been the main problems facing the survival and development of mankind. Due to the adverse factors such as population growth, climate warming and water shortage, the possibility of increasing grain production by traditional farming methods alone has been very limited. Transgenic biotechnology is an important way to solve these problems. Since the birth of transgenic tobacco in 1983, transgenic technology has been rapidly infiltrating and developing into the field of agriculture. By 2014, the global area of genetically modified crops has reached 181.5 million hectares, and the planting area of 2015 global genetically modified crops has declined for the first time, which is 1% less than the previous year. GM food has become a new type of food in the 21 st century on the table of ordinary people. It can be said that the emergence of genetically modified food is a revolution in the field of food. The development of genetically modified food has brought enormous economic and social benefits to human society, but it has scientific complexity and uncertainty, which may have potential risks and hazards to human health and ecological environment. Therefore, GM food safety has become the focus of global attention and debate. The safety of genetically modified food is related to the vital interests of the public and the national economic interests. It is bound to become the meaning of various countries to strengthen the legislation of safety supervision. Therefore, based on the national interests and their respective legislative principles, countries in the world implement different regulatory systems and models of genetically modified food safety, the most representative of which are the European Union, the United States and Japan. The first part of this paper describes the basic situation of genetically modified food safety supervision. The second part introduces and analyzes the European Union, the United States, Japan and international organizations of genetically modified food safety regulatory legislation system, compared and studied, summed up its laws and experiences. The third part expounds the current situation of the legislation on the safety supervision of genetically modified foods in China, and points out many defects and problems in the legislation of safety supervision of genetically modified foods in China. In the fourth part, we should keep a cautious and optimistic attitude towards GM food, insist on innovation, coordination, green, open, shared development concept, clarify the principle of legislation, and introduce the thinking of "Internet". Suggestions and countermeasures are put forward to establish an effective legal system and regulatory system to ensure the implementation of the safety supervision of genetically modified foods.
