ECFA框架下兩岸經(jīng)貿(mào)糾紛解決機制探析

【摘要】：海峽兩岸經(jīng)貿(mào)關(guān)系從“小三通”的突破,到“大三通”的實現(xiàn),終于在2010年6月迎來了《海峽兩岸經(jīng)濟合作框架協(xié)議》(ECFA)。ECFA的簽署開啟兩岸大交流、大合作、大融合、大發(fā)展的新篇章。兩岸經(jīng)貿(mào)持續(xù)升溫,隨之而來的兩岸間的經(jīng)貿(mào)糾紛也不僅在數(shù)量上增多而且也在種類上有新類型出現(xiàn)�，F(xiàn)有的糾紛解決機制缺陷逐漸顯現(xiàn),難以滿足當(dāng)前海峽兩岸解紛需求。在ECFA框架下,研究兩岸經(jīng)貿(mào)糾紛解決機制意義重大。本文運用比較歷史研究方法,對于海峽兩岸經(jīng)貿(mào)發(fā)展歷史以及現(xiàn)有糾紛解決方式進行梳理,并對現(xiàn)有糾紛解決模式下各種糾紛解決途徑進行對比分析。同時,采用法社會學(xué)分析方法,考察兩岸經(jīng)貿(mào)關(guān)系語境下不同糾紛解決途徑的社會基礎(chǔ)、運行現(xiàn)狀,透析出這些糾紛解決方式在具體運用中的“地方性知識”,為在ECFA框架下兩岸經(jīng)貿(mào)糾紛解決模式選擇,以及ADR技術(shù)協(xié)同運用提供實踐的參考。 本文共分為三部分。第一章梳理了海峽兩岸經(jīng)貿(mào)發(fā)展脈絡(luò),分析了微觀的企業(yè)層面的投資糾紛和宏觀的行業(yè)層面的競爭性糾紛類型,歸納出了海峽兩岸經(jīng)貿(mào)糾紛的四個特點。第二章概括了現(xiàn)行兩岸經(jīng)貿(mào)糾紛解決的法律法規(guī)和相應(yīng)的糾紛解決途徑,著重分析了既有糾紛解決途徑的優(yōu)缺點,為后文的新的糾紛解決機制構(gòu)想提供參考依據(jù)。第三章在前文分析的基礎(chǔ)上多方面論證ECFA框架下構(gòu)建兩岸區(qū)際經(jīng)貿(mào)仲裁中心的必要性和可能性,對其具體的運行程序進行了初步的設(shè)置。同時,進一步挖掘兩岸共性的地方解紛資源,論證在兩岸經(jīng)貿(mào)仲裁中心運行過程中調(diào)解人角色扮演技術(shù)、調(diào)解-仲裁相結(jié)合技術(shù)和“五緣”解紛技術(shù)等多種解紛技術(shù)的協(xié)同運用。
[Abstract]:From the breakthrough of the "small three links" to the realization of the "big three links", the signing of the "Framework Agreement on Cross-Strait Economic Cooperation" (ECFA). The defects of the existing dispute resolution mechanism gradually appear, and it is difficult to meet the current cross-strait dispute resolution needs. Under the framework of ECFA, it is of great significance to study the settlement mechanism of cross-strait economic and trade disputes. In this paper, the comparative historical research method is used to sort out the history of cross-strait economic and trade development and the existing dispute resolution methods, and to compare and analyze the various dispute resolution methods under the existing dispute resolution mode. At the same time, by using the method of sociology of law, this paper investigates the social basis and current situation of different dispute resolution approaches in the context of cross-strait economic and trade relations, and analyzes the "local knowledge" of these dispute resolution methods in the specific application. It provides a practical reference for the choice of cross-strait economic and trade dispute resolution mode under the framework of ECFA, as well as the cooperative application of ADR technology. This paper is divided into three parts. The first chapter combs the development of cross-strait economic and trade, analyzes the microcosmic investment disputes at the enterprise level and the competitive disputes at the macro industry level, and concludes the four characteristics of cross-strait economic and trade disputes. The second chapter summarizes the current cross-strait economic and trade dispute settlement laws and regulations and the corresponding dispute resolution approach, focusing on the advantages and disadvantages of the existing dispute resolution approach, to provide a reference for the new dispute resolution mechanism. The third chapter discusses the necessity and possibility of establishing the cross-straits inter-regional economic and trade arbitration center under the framework of ECFA on the basis of the previous analysis. At the same time, further excavating the common local resources for resolving disputes between the two sides of the strait and demonstrating the technology of mediators' role playing in the course of the operation of the cross-strait economic and trade arbitration center, The cooperation of mediation-arbitration and five-edge dispute-solving techniques.
