【摘要】：現(xiàn)代憲法學(xué)認(rèn)為,民族國家是現(xiàn)代憲法的社會基礎(chǔ),民族國家產(chǎn)生之前或消亡之后不存在憲法。因此,憲法的歷史與民族國家的歷史相同。然而,以歐洲共同體為基礎(chǔ)的《歐盟憲法》表明,憲法與民族國家并不存在必然的聯(lián)系。這挑戰(zhàn)了現(xiàn)代憲法的歷史觀,并為重構(gòu)憲法學(xué)的歷史理論提供了契機(jī)。
[Abstract]:The modern constitutional jurisprudence holds that the nation-state is the social foundation of the modern constitution, and there is no constitution before or after its demise. Therefore, the history of the Constitution is the same as that of the nation-state. However, the EU Constitution, based on the European Community, shows that there is no necessary connection between the Constitution and the nation-state. This challenges the historical view of the modern constitution and provides an opportunity for reconstructing the historical theory of constitutional jurisprudence.
