【摘要】：聯(lián)合國《兒童權(quán)利公約》于我國生效24載,然囿于中華幾千年傳統(tǒng)觀念,未成年人隱私權(quán)保護仍處邊緣化位置,相關(guān)理論研究亦顯薄弱。而于變革迭起、風(fēng)云激蕩之新聞傳媒領(lǐng)域,具備相對優(yōu)勢的電視新聞卻并未在未成年人隱私權(quán)保護方面做到先進與妥當(dāng)。鑒于此,探索電視新聞報道中未成人隱私權(quán)保護對于法學(xué)與新聞學(xué)的相關(guān)理論研究與具體實務(wù)均有重要意義。以往數(shù)千年時間里,華夏大地究竟是真的有著愛護兒童的悠久傳統(tǒng),還僅是父權(quán)至上冷酷觀念中偶爾體現(xiàn)的一絲溫情?此話題雖見仁見智,但長期以來兒童并無獨立權(quán)利主體地位而僅被視為社會或家庭一部分的境地當(dāng)無爭議。然隨社會進步,兒童權(quán)利愈發(fā)被關(guān)注與承認,兒童作獨立權(quán)利主體之意識亦逐漸覺醒,《兒童權(quán)利公約》的“最大利益原則”于中國有了生根發(fā)展之土壤,并理應(yīng)于保護兒童的法律法規(guī)和實踐工作中得以體現(xiàn)和適用,電視新聞報道中的未成年人隱私權(quán)保護即當(dāng)遵循此原則。未成年人身體未長成、心智未開啟,故電視新聞報道中如欲以“最大利益原則”指導(dǎo)其隱私權(quán)保護,則必堅守媒體告知、隱私權(quán)人同意及媒體更嚴格保護三大原則以求對未成年人隱私權(quán)周全穩(wěn)妥之保護。于此理論基礎(chǔ)之上,我國當(dāng)構(gòu)建完善之制度,以法律與行業(yè)規(guī)范實現(xiàn)電視新聞報道中未成年人隱私權(quán)之保障。同時,通過賦予未成年人隱私權(quán)保護方面的獨立訴權(quán)及設(shè)立未成年人隱私權(quán)獨立訴訟中的程序監(jiān)理人制度,為權(quán)利提供可行之救濟。
[Abstract]:The United Nations Convention on the Rights of the Child (CRC) has been in force for 24 years in China. However, because of the traditional Chinese concept for thousands of years, the protection of minors' right to privacy is still marginalized, and the relevant theoretical research is also weak. However, in the field of news media, the relative advantage of TV news has not been advanced and appropriate in the protection of minors' right to privacy. In view of this, it is of great significance to explore the protection of the right to privacy in television news reports for the relevant theoretical research and practical practice of law and journalism. In the past thousands of years, the land of China really has a long tradition of caring for children, or is it just a touch of warmth occasionally reflected in the ruthless concept of patriarchal supremacy? Although there are different opinions on this topic, it is not disputed that children have no independent subject status and are only regarded as a part of society or family for a long time. However, with the progress of society, children's rights have been paid more and more attention to and recognized, and the awareness of children as independent subjects of rights has gradually awakened. The "principle of best interests" of the Convention on the Rights of the Child has taken root and developed in China. And should be in the protection of children in the laws and regulations and practical work can be reflected and applied, television news reports in the protection of the right to privacy of minors should follow this principle. Minors have not grown up physically and their minds have not been opened. Therefore, if television news reports want to use the "best interests principle" to guide their right to privacy protection, they must stick to the media informing them. Privacy consent and media more strict protection of the three principles to protect the privacy of minors. On the basis of this theory, our country should construct perfect system and realize the protection of minors' right of privacy in TV news reports by law and industry standard. At the same time, it can provide feasible relief for the right by endowing the independent litigation right in the protection of the right of privacy of the minor and establishing the system of the procedure supervisor in the independent lawsuit of the right of privacy of the minor.
