【摘要】：隨著工業(yè)技術(shù)的發(fā)展和人類社會(huì)的進(jìn)步,新的環(huán)境問題層出不窮,特別是在海洋環(huán)境問題,其因涉及范圍廣、危害程度高和損害結(jié)果難以挽回,已經(jīng)成為國際社會(huì)廣泛關(guān)注的環(huán)境問題之一。為此各個(gè)國家和國際組織制定的一系列相關(guān)的法律文件,風(fēng)險(xiǎn)預(yù)防原則就是有由此發(fā)展出來的解決海洋環(huán)境保護(hù)上存在的科學(xué)不確定性的法律原則,其核心內(nèi)容是:在危險(xiǎn)行為或者物質(zhì)與人體傷害或者環(huán)境損害之間的關(guān)系缺乏科學(xué)上的確定證據(jù)時(shí),應(yīng)當(dāng)及時(shí)采取預(yù)防措施,以達(dá)到保護(hù)人體生命健康和海洋環(huán)境的目的。1 本文分為五個(gè)部分。 引言部分主要介紹了國際環(huán)境問題的發(fā)展和現(xiàn)狀,分析了風(fēng)險(xiǎn)預(yù)防原則的產(chǎn)生原因及研究價(jià)值,并且介紹了本文主要采用的幾種研究方法。 第一部分主要研究與風(fēng)險(xiǎn)預(yù)防原則相關(guān)的理論問題,包括其產(chǎn)生和發(fā)展?fàn)顩r,法律含義和法律地位。風(fēng)險(xiǎn)預(yù)防原則為了更好地保護(hù)國際海洋環(huán)境而發(fā)展起來的一項(xiàng)習(xí)慣國際法原則。 第二部分主要研究風(fēng)險(xiǎn)預(yù)防原則的法律實(shí)踐,包括其在幾個(gè)重要海洋環(huán)境問題中的適用,如何解決現(xiàn)存的實(shí)踐問題以及由此得出的經(jīng)驗(yàn)和教訓(xùn); 第三部分主要研究的是風(fēng)險(xiǎn)預(yù)防原則與中國海洋環(huán)境保護(hù)的相關(guān)問題,包括中國海洋環(huán)境的主要問題和立法現(xiàn)狀,風(fēng)險(xiǎn)預(yù)防原則在中國現(xiàn)有海洋環(huán)境保護(hù)立法中的具體體現(xiàn)以及如何進(jìn)一步完善。 結(jié)語部分主要是對(duì)海洋環(huán)境保護(hù)中的風(fēng)險(xiǎn)預(yù)防原則的研究現(xiàn)狀進(jìn)行總結(jié),并指出其正處在迅速發(fā)展的過程當(dāng)中,是一項(xiàng)正在形成的重要習(xí)慣國際法原則,能夠有效解決當(dāng)今復(fù)雜的海洋環(huán)境問題,我國應(yīng)在結(jié)合本國具體國情的基礎(chǔ)上引入其相關(guān)理念,以更有效得保護(hù)海洋環(huán)境。
[Abstract]:With the development of industrial technology and the progress of human society, new environmental problems emerge in an endless stream, especially in the marine environment, because of their wide scope, high degree of harm and irreparable damage, It has become one of the environmental problems concerned by the international community. For this reason, a series of relevant legal documents developed by various countries and international organizations, the principle of risk prevention is the legal principle developed from this to address the scientific uncertainties existing in the protection of the marine environment. Its core content is: in the absence of scientific and definitive evidence on the relationship between dangerous acts or substances and human injury or environmental damage, preventive measures should be taken in time, In order to protect human life and health and marine environment. 1 this paper is divided into five parts. The introduction mainly introduces the development and present situation of international environmental problems, analyzes the causes of the principle of risk prevention and its research value, and introduces several research methods used in this paper. The first part mainly studies the theoretical problems related to the principle of risk prevention, including its emergence and development, legal meaning and legal status. A principle of customary international law developed to better protect the international marine environment. The second part mainly studies the legal practice of the principle of risk prevention, including its application in several important marine environmental problems, how to solve the existing practical problems and the experience and lessons learned therefrom; The third part mainly studies the risk prevention principle and the related problems of China's marine environmental protection, including the main problems of China's marine environment and the current legislative situation. The principle of risk prevention is embodied in the existing marine environmental protection legislation in China and how to perfect it further. The conclusion is mainly a summary of the research status of the principle of risk prevention in the protection of the marine environment, and points out that it is in the process of rapid development and is an important and emerging principle of customary international law. In order to effectively solve the complex marine environment problems, China should introduce its related concepts on the basis of its specific national conditions in order to protect the marine environment more effectively.
