【摘要】：調查程序是《經(jīng)濟、社會和文化權利國際公約任擇議定書》中規(guī)定的一項準司法程序,對《經(jīng)濟、社會和文化權利國際公約》及其任擇議定書規(guī)定的締約國報告程序、個人來文程序和國家間指控程序具有輔助作用。在《經(jīng)濟、社會和文化權利國際公約任擇議定書》制定之前,經(jīng)濟、社會和文化權利委員會為了審議多米尼加共和國和巴拿馬兩國的國家報告,曾成功地對兩國開展過調查活動。在起草該任擇議定書的過程中,對是否規(guī)定以及如何規(guī)定調查程序曾發(fā)生過一些爭論�！督�(jīng)濟、社會和文化權利國際公約任擇議定書》中的調查程序繼承和發(fā)展了此前聯(lián)合國人權公約中的調查程序,并對此后的人權公約中的調查程序提供了借鑒。迄今為止,該任擇議定書的20個締約國中只有4個接受調查程序,比例明顯偏低。該調查程序的批準和實施都不會是一帆風順的,但它畢竟為《經(jīng)濟、社會和文化權利國際公約》的實施增加了一種監(jiān)督程序,為經(jīng)濟、社會和文化權利提供了潛在的更廣泛的保護空間。
[Abstract]:The inquiry procedure is a quasi-judicial procedure under the optional Protocol to the International Covenant on Economic, Social and Cultural Rights, which provides for the State party reporting procedure under the International Covenant on Economic, Social and Cultural Rights and the optional Protocol thereto, The individual communications procedure and the inter-State complaint procedure are complementary. Pending the elaboration of the optional Protocol to the International Covenant on Economic, Social and Cultural Rights, the Committee on Economic, Social and Cultural Rights, in order to consider the national reports of the Dominican Republic and Panama, Successful investigations were carried out in both countries. During the drafting of the optional Protocol, there was some debate over whether and how to provide for an inquiry procedure. The inquiry procedure in the optional Protocol to the International Covenant on Social and Cultural Rights inherits and develops the inquiry procedure in the previous United Nations human rights conventions and provides a reference to the inquiry procedure in the subsequent human rights conventions. To date, only 4 out of 20 States parties to the optional Protocol are subject to the inquiry procedure, which is significantly low. The ratification and implementation of the inquiry procedure will not be smooth, but it adds a monitoring procedure to the implementation of the International Covenant on Economic, Social and Cultural Rights for the benefit of the economy, Social and cultural rights provide potential for broader protection.
