【摘要】：《馬拉喀什條約》為締約方設(shè)定了在版權(quán)法中為視障者和其他閱讀障礙者規(guī)定限制與例外的義務(wù),并有相應(yīng)的靈活性。《中華人民共和國(guó)著作權(quán)法》和《信息網(wǎng)絡(luò)傳播權(quán)保護(hù)條例》與《馬拉喀什條約》的要求存在差距。為了批準(zhǔn)加入該條約并保障我國(guó)視障者的利益,我國(guó)著作權(quán)立法應(yīng)當(dāng)擴(kuò)大"受益人"和"無(wú)障礙格式版"的范圍;將版權(quán)限制與例外適用的作品類型擴(kuò)大至影視作品;將其針對(duì)的專有權(quán)利擴(kuò)大至表演權(quán)和翻譯權(quán)(翻譯成少數(shù)民族語(yǔ)言文字),以及復(fù)制有聲書時(shí)涉及的表演者權(quán)和錄制者權(quán);以較寬松的條件允許為制作無(wú)障礙格式版而規(guī)避技術(shù)措施。我國(guó)還應(yīng)為"被授權(quán)實(shí)體"制定一整套嚴(yán)密、精細(xì)和具有可操作性的管理制度和行為規(guī)范。
[Abstract]:The Marrakech Treaty imposes on parties the obligation to impose restrictions and exceptions in copyright law for visually impaired persons and other persons with reading disabilities, There is a gap between the copyright Law of the people's Republic of China and the regulations on the Protection of the right of dissemination of Information Network and the Marrakech Treaty. In order to ratify the treaty and protect the interests of the visually impaired, the copyright legislation of our country should expand the scope of "beneficiary" and "barrier-free format version", and extend the copyright restriction and the type of works with exceptional application to film and television works. (B) extend the exclusive rights it targets to the right to perform and translate (translated into minority languages), as well as the rights of performers and producers involved in the reproduction of audiobooks; Technical measures are circumvented by looser conditions allowing for the production of barrier-free format versions. China should also establish a set of strict, precise and operable management system and code of conduct for authorized entities.
