【摘要】：《能源憲章條約》是一個(gè)在加強(qiáng)國(guó)際社會(huì)能源領(lǐng)域合作方面具有重要意義的多邊協(xié)議�？沙掷m(xù)發(fā)展是該條約的目標(biāo)之一。在新的全球經(jīng)濟(jì)發(fā)展勢(shì)頭帶動(dòng)下,各國(guó)將開動(dòng)新的能源外交,意味著新一輪的能源爭(zhēng)奪、能源對(duì)話、能源合作將迅速開展,而與此俱來的是全球中發(fā)達(dá)國(guó)家相互之間、發(fā)達(dá)國(guó)家與發(fā)展中國(guó)家、發(fā)展中國(guó)家之間交流磋商帶來的經(jīng)濟(jì)不安定因素,包括各種投資方式、貿(mào)易規(guī)則、爭(zhēng)端解決機(jī)制、環(huán)境保護(hù)等存在的差異問題�！赌茉磻椪聴l約》是目前世界上唯一一個(gè)能牽制主要能源東道國(guó)與投資國(guó)之間的一個(gè)多方協(xié)定,具有一定的法律意義。本文主要對(duì)《能源憲章條約》的部分主要條款和主旨精神給予解析,并對(duì)在新時(shí)期下的全球能源競(jìng)爭(zhēng)中《能源憲章條約》所發(fā)揮的積極作用給予肯定,同時(shí)提出不足之處以供以后的完善。具體說來,首先,筆者在文章的第一部分簡(jiǎn)要介紹《能源憲章條約》的產(chǎn)生背景,這是對(duì)其條款所具有國(guó)際法性質(zhì)的一個(gè)根本原因。其次,筆者在文章的第二部分著重闡明《能源憲章條約》對(duì)投資范圍的劃分、投資者待遇條款以及投資規(guī)則的立約主旨等涉及能源投資的重要方面。再次,筆者在文章的第三部分將《能源憲章條約》以及其議定書中有關(guān)環(huán)境保護(hù)和能源運(yùn)輸方面的相關(guān)條款摘引,并立足于條約的宗旨和目標(biāo)的基礎(chǔ)上著重分析環(huán)境保護(hù)條款的法律性質(zhì),同時(shí)肯定條約對(duì)于過境運(yùn)輸方面的突出貢獻(xiàn)。最后,筆者將《能源憲章條約》在爭(zhēng)端解決機(jī)制和其他一些在能源貿(mào)易活動(dòng)過程中需要重視的規(guī)范條款進(jìn)行合理的解讀,并利用一些實(shí)際中存在的現(xiàn)象和案例來說明條約的規(guī)范性和適用性�？傊�,《能源憲章條約》在新時(shí)期的能源對(duì)話和能源交流合作中仍然并將繼續(xù)發(fā)揮著具有不可替代的約束性法律作用。
[Abstract]:The Energy Charter Treaty is a multilateral agreement of great significance in strengthening international cooperation in the field of energy. Sustainable development is one of the objectives of the treaty. Driven by the new momentum of global economic development, countries will launch new energy diplomacy, which means a new round of energy competition, energy dialogue and energy cooperation will develop rapidly, and this will be accompanied by the mutual development of the developed countries in the world. Economic instability resulting from the exchange of consultations between developed and developing countries, including various forms of investment, trade rules, dispute settlement mechanisms, The "Energy Charter Treaty" is the only multi-party agreement in the world which can restrain the host country and the investor country of the main energy, and has certain legal significance. This paper mainly analyzes some of the main provisions and gist of the Energy Charter Treaty, and affirms the positive role played by the Energy Charter Treaty in the global energy competition in the new era. At the same time, put forward deficiencies for future improvement. Specifically, in the first part of the article, the author briefly introduces the background of the "Energy Charter Treaty", which is a fundamental reason for the international law nature of its provisions. Secondly, in the second part of the article, the author emphasizes the division of investment scope in the "Energy Charter Treaty", the terms of the treatment of investors and the main purpose of the contract of investment rules and so on, which are related to the important aspects of energy investment. Thirdly, in the third part of the article, the author extracts the relevant provisions of the Energy Charter Treaty and its protocol on environmental protection and energy transport. Based on the object and purpose of the treaty, the legal nature of the environmental protection clause is analyzed, and the outstanding contribution of the treaty to transit transport is affirmed. Finally, the author makes a reasonable interpretation of the "Energy Charter Treaty" in the dispute settlement mechanism and other normative provisions that should be attached importance to in the process of energy trade activities. Some practical phenomena and cases are used to illustrate the normative and applicability of the treaty. In conclusion, the Energy Charter Treaty still plays and will continue to play an irreplaceable binding legal role in energy dialogue and energy exchange and cooperation in the new era.
