【摘要】：提單在國際商事活動(dòng)中發(fā)揮著重要作用。隨著經(jīng)濟(jì)和技術(shù)水平的不斷提高,國際貿(mào)易中快速化、信息化需求不斷增強(qiáng),傳統(tǒng)提單的缺陷日益明顯,電子提單取代傳統(tǒng)提單成為未來發(fā)展的必然趨勢。 電子提單作為區(qū)別于傳統(tǒng)提單的新型國際貿(mào)易憑據(jù),’其法律效力是影響和制約其自身在實(shí)踐中應(yīng)用普及的重要因素。鑒于此,筆者以電子提單的法律效力為核心,通過比較研究各國電子提單相關(guān)立法實(shí)踐,結(jié)合當(dāng)前有關(guān)電子提單的相關(guān)理論研究,指出了當(dāng)前電子提單理論及實(shí)踐中關(guān)于電子提單法律效力認(rèn)定不足的問題,論證了電子提單的權(quán)利性質(zhì)、物權(quán)和債權(quán)效力的實(shí)現(xiàn)、證據(jù)效力等問題,并藉此對(duì)電子提單的法律效力做了明確的界定。在文章的最后,筆者針對(duì)我國國際貿(mào)易中電子提單使用的現(xiàn)狀,扼要分析了相關(guān)的法律問題,提出了重新構(gòu)建我國電子提單法律制度的思路。
[Abstract]:Bill of lading plays an important role in international commercial activities. With the development of economy and technology, the international trade becomes more and more rapid, the demand for information is increasing, the defects of traditional bill of lading are becoming more and more obvious, and the replacement of traditional bill of lading by electronic bill of lading has become an inevitable trend in the future. Electronic bill of lading is a new kind of international trade evidence which is different from traditional bill of lading. Its legal effect is an important factor that influences and restricts the popularization of electronic bill of lading in practice. In view of this, the author takes the legal effect of electronic bill of lading as the core, through the comparative study of the relevant legislative practice of electronic bill of lading in various countries, combined with the current relevant theoretical research of electronic bill of lading. This paper points out the problems in the theory and practice of electronic bill of lading that the legal effect of electronic bill of lading is insufficient, and proves the nature of the right of electronic bill of lading, the realization of the validity of real right and creditor's right, the validity of evidence, etc. The legal effect of electronic bill of lading is clearly defined. At the end of the paper, according to the current situation of the use of electronic bill of lading in international trade in China, the author briefly analyzes the relevant legal problems, and puts forward the idea of reconstructing the legal system of electronic bill of lading in China.
