【摘要】：中哈霍爾果斯國際邊境合作中心是全世界范圍內(nèi)的一項新事物，它的跨國建立和國際合作運營模式，既不是世界上傳統(tǒng)意義的“自由經(jīng)濟(jì)區(qū)”或“自由貿(mào)易區(qū)”，也不同于我國東南沿海的經(jīng)濟(jì)特區(qū)。它是國際經(jīng)濟(jì)貿(mào)易活動中兩國加強(qiáng)經(jīng)貿(mào)合作的新嘗試，有許多新的問題需要我們加緊研究和探索。通過中哈霍爾果斯國際邊境合作中心的國際貿(mào)易自由港作用、國際大通道作用，對中哈霍爾果斯國際邊境合作中心未來的發(fā)展走向、聯(lián)通輻射到西亞、南亞、東歐及整個歐洲的發(fā)展前景進(jìn)行科學(xué)的預(yù)測研究。讓中哈霍爾果斯國際邊境合作中心這塊試驗田充分發(fā)揮示范帶動作用，促進(jìn)我國與中亞各國區(qū)域經(jīng)濟(jì)協(xié)調(diào)健康發(fā)展，有力推動我國的西部大開發(fā)戰(zhàn)略順利進(jìn)展。充分發(fā)揮中哈霍爾果斯國際邊境合作中心的國際貿(mào)易自由港作用，探索一條我國西部欠發(fā)達(dá)地區(qū)和中亞國家開拓國際市場，吸引外資，，突破內(nèi)陸國家和地區(qū)沒有出�？诘木窒�。 中哈霍爾果斯國際邊境合作中心是一種“一區(qū)跨兩國”的邊境合作新模式，它是中國探索與周邊國家新型經(jīng)貿(mào)合作的一次有益嘗試；是中哈兩國國家間市場的連接點，它在很大程度上發(fā)揮著集聚中哈兩國商品、資本、勞動力等各種要素并完善它的市場流通的功能。中哈合作中心在市場要素集聚方面的作用為各種制度的發(fā)展提供了空間，這些制度的建設(shè)狀況在很大程度上決定著中哈合作中心運行的效率，而中哈合作中心法律制度的發(fā)展對國際貿(mào)易的開展具有決定性的影響。本文的切入點是中哈霍爾果斯邊境合作中心創(chuàng)建歷程與緣由，并在分析中哈合作中心的法律制度基層之上，結(jié)合中國西部大開發(fā)對其的特殊要求，中哈兩國共同發(fā)展邊境貿(mào)易的需求，對支持口岸發(fā)展的國內(nèi)法和國際法體系進(jìn)行分析，進(jìn)而提出中哈霍爾果斯國際邊境合作中心制度完善的設(shè)想，構(gòu)建起口岸發(fā)展的區(qū)域性法律體系。
[Abstract]:The Center for International Border Cooperation between China and Kazakhstan is a new thing in the world. Its transnational establishment and mode of operation of international cooperation are neither "free economic zones" or "free trade zones" in the traditional sense of the world. It is also different from the special economic zones along the southeast coast of our country. It is a new attempt to strengthen economic and trade cooperation between the two countries in international economic and trade activities. Through the role of the free port of international trade and the role of the international large channel of the China-Kazakhstan Holgos International Border Cooperation Center, the future development trend of the China-Kazakhstan Horgos International Border Cooperation Center will be radiated to West Asia and South Asia. The development prospects of Eastern Europe and Europe as a whole are scientifically predicted. Let the Sino-Kazakh Horgos International Border Cooperation Center give full play to the role of demonstration and drive, promote the healthy and coordinated development of regional economy between China and the countries of Central Asia, and promote the smooth progress of China's strategy of developing the western region. We should give full play to the role of the China-Kazakhstan Horgos International Border Cooperation Center as a free port for international trade, and explore a way to open up international markets in the underdeveloped regions of western China and Central Asia, attract foreign capital, and break through the limitation that landlocked countries and regions do not have access to the sea. The Center for International Border Cooperation between China and Kazakhstan is a new mode of border cooperation between "one region and two countries", which is a beneficial attempt for China to explore new economic and trade cooperation with neighboring countries. It is the connection point of the market between China and Kazakhstan, it plays the function of concentrating the goods, capital, labor force and other factors of China and Kazakhstan to a great extent and perfecting the circulation of its market. The role of China-Kazakhstan cooperation center in the agglomeration of market elements provides space for the development of various systems, and the construction of these systems largely determines the efficiency of the operation of the Sino-Kazakh cooperation center. The development of the legal system of Sino-Kazakh Cooperation Center has a decisive influence on the development of international trade. The starting point of this paper is the course and cause of the establishment of the China-Kazakhstan Horgoz Border Cooperation Center, and on the basis of analyzing the legal system of the China-Kazakhstan Cooperation Center, combining with the special requirements of the great development of China's western region, The needs of China and Kazakhstan to jointly develop border trade, to analyze the system of domestic law and international law supporting the development of ports, and to put forward the idea of perfecting the system of Sino-Kazakh International Border Cooperation Center. Build a regional legal system for port development.
