【摘要】：郵輪曾經(jīng)是主要的海上旅客運(yùn)輸工具,承擔(dān)大陸各洲之間的旅客運(yùn)輸任務(wù)超過百年。自從大型民航客機(jī)出現(xiàn)之后,郵輪的功能發(fā)生了重大轉(zhuǎn)變,現(xiàn)在,郵輪主要為旅客提供海上旅游服務(wù)。 從上世紀(jì)九十年代以來,郵輪旅游業(yè)已經(jīng)成為國際旅游產(chǎn)業(yè)中增長(zhǎng)最快的一個(gè)項(xiàng)目。隨著我國經(jīng)濟(jì)快速發(fā)展,乘坐郵輪到海上觀光旅游也成為中國旅游者的新時(shí)尚,從而也引發(fā)了郵輪旅游過程中的一些法律問題。 本文試圖通過分析郵輪旅游合同,論述為人們提供綜合性休閑娛樂服務(wù)的現(xiàn)代郵輪承運(yùn)人在法律上應(yīng)當(dāng)承擔(dān)的責(zé)任。本文分為三部分,第一部分闡述了郵輪運(yùn)輸?shù)臍v史、發(fā)展與現(xiàn)狀；第二部分重點(diǎn)討論了郵輪旅游合同的性質(zhì)、內(nèi)容和特征；第三部分主要分析了郵輪承運(yùn)人的法律責(zé)任。 本文作者對(duì)郵輪旅游合同和郵輪承運(yùn)人的責(zé)任問題作了一些粗淺的探討,希望能夠?qū)ξ覈磥淼暮Ｉ下糜瘟⒎ㄆ鸬叫┰S幫助的作用。
[Abstract]:Cruise ships were once the main means of passenger transport by sea, undertaking passenger transport between continents for more than a hundred years. Since the emergence of large civil aviation passenger aircraft, the functions of cruise ships have undergone a major change. Now, cruise ships mainly provide maritime travel services for passengers. Since the 1990 s, cruise tourism has become one of the fastest growing projects in the international tourism industry. With the rapid development of China's economy, cruise to sea tourism has become a new fashion for Chinese tourists, which has also caused some legal problems in the process of cruise tourism. This paper attempts to discuss the legal liability of modern cruise carriers who provide people with comprehensive leisure and entertainment services through the analysis of cruise tourism contracts. This paper is divided into three parts: the first part describes the history, development and present situation of cruise shipping; the second part focuses on the nature, content and characteristics of the cruise contract; the third part mainly analyzes the legal liability of the cruise carrier. In this paper, the author makes a brief discussion on the cruise contract and the liability of the cruise carrier, hoping to be helpful to the future maritime tourism legislation in China.
