海事請(qǐng)求類型化下船舶扣押管轄權(quán)審視

【摘要】：作為"對(duì)物訴訟"和財(cái)產(chǎn)保全理論互為折中和協(xié)調(diào)的產(chǎn)物,船舶扣押管轄權(quán)的啟動(dòng)是基于法定的特定范圍,即由海事事由引發(fā)的海事請(qǐng)求。理解和優(yōu)化船舶扣押管轄權(quán)具有不同的進(jìn)路,即可扣押船舶范圍的界定、錯(cuò)誤扣押船舶的救濟(jì)以及明確海事請(qǐng)求的種類。然而,在海事請(qǐng)求類型化日益盛行、"對(duì)物訴訟"模式日漸式微以及航運(yùn)實(shí)踐中特定船舶扣押意旨的趨向下,海事請(qǐng)求的類型化以優(yōu)化船舶扣押管轄權(quán)程序成為必然。凸顯海事請(qǐng)求的類型化以優(yōu)化船舶扣押管轄權(quán)程序的啟動(dòng)并不是一個(gè)孤立的問(wèn)題。重視當(dāng)事人的披露義務(wù)和強(qiáng)化法院的審慎性審查責(zé)任,成為構(gòu)建富有可行性和合理性的船舶扣押管轄權(quán)體系的應(yīng)然進(jìn)路。
[Abstract]:As the result of compromise and coordination between action in rem and property preservation theory, the initiation of ship arrest jurisdiction is based on the specific scope of law, that is, maritime claim initiated by maritime cause. To understand and optimize the jurisdiction of ship arrest has different approaches, that is to say, the definition of the scope of arrest, the relief of the wrong arrest of the ship and the definition of the type of maritime claim. However, with the increasing popularity of the classification of maritime claims, the declining pattern of "action in rem" and the tendency of specific ship arrest intention in shipping practice, the classification of maritime claims to optimize the procedures of ship arrest jurisdiction becomes inevitable. It is not an isolated problem to highlight the classification of maritime claims in order to optimize the initiation of ship arrest jurisdiction procedure. Paying attention to the disclosure obligation of the parties and strengthening the court's duty to examine prudently is the way to construct a feasible and reasonable system of ship arrest jurisdiction.
