【摘要】：歐洲聯(lián)盟作為當(dāng)今國際社會(huì)中最具影響力的區(qū)域性國際組織,其產(chǎn)生和發(fā)展歷程始終離不開歐盟條約的支撐作用。歐盟條約在法律層面不斷的推動(dòng)著歐洲一體化的發(fā)展進(jìn)程。司法實(shí)踐中,歐盟條約被經(jīng)常的適用,在這一適用過程中歐盟條約因其各種內(nèi)外因素的存在,對(duì)它的法律解釋成為必然。本文從宏觀的層面論述了歐盟條約的解釋,并通過與其他國際條約的比較得出了其解釋的特殊性。這一解釋的特殊性既是對(duì)傳統(tǒng)條約解釋規(guī)則的發(fā)展,也對(duì)世界范圍內(nèi)的其他國際主體在解釋條約時(shí)有著積極的借鑒意義。 本文除引言和結(jié)語之外共分為三章。第一章從總體上對(duì)歐盟條約的解釋進(jìn)行了相關(guān)論述,介紹了歐盟條約的概況、歐盟條約解釋的理論依據(jù)以及其解釋的主體與啟動(dòng)程序等相關(guān)內(nèi)容。第二章對(duì)歐盟條約解釋的原則與方法進(jìn)行了深入的論述,也是本文的重點(diǎn),在闡述歐盟條約解釋原則與方法之前著重分析了傳統(tǒng)條約解釋理論與《維也納條約法公約》中條約解釋理論的條款,對(duì)歐盟條約解釋的善意解釋、統(tǒng)一解釋的基本原則進(jìn)行了闡述,并指出歐盟條約解釋的具體方法有字面解釋、歷史解釋、系統(tǒng)和目的解釋以及比較法解釋這四種方法。第三章在總結(jié)前兩章的基礎(chǔ)之上闡述了歐盟條約解釋的特殊性,歐盟條約解釋的特殊性也是多種因素綜合起作用的結(jié)果,文章最后對(duì)歐盟條約解釋在歐洲一體化中的重要作用進(jìn)行了分析。
[Abstract]:The European Union is the most influential regional international organization in the international community today, and its emergence and development process can not be separated from the supporting role of EU treaties. European Union treaties promote the development of European integration on the legal level. In judicial practice, EU treaties are often applied, in the process of application, due to the existence of various internal and external factors, the legal interpretation of EU treaties becomes inevitable. This paper discusses the interpretation of EU treaties from the macro level, and obtains the particularity of its interpretation by comparison with other international treaties. The particularity of this interpretation is not only the development of the traditional rules of treaty interpretation, but also the positive reference to other international subjects in the world. In addition to the introduction and conclusion, this article is divided into three chapters. The first chapter discusses the interpretation of EU treaties in general, introduces the general situation of EU treaties, the theoretical basis of EU treaty interpretation, the main body of its interpretation and the initiation procedure, and so on. The second chapter has carried on the thorough elaboration to the European Union treaty interpretation principle and the method, is also the focal point of this article, Before expounding the principles and methods of the EU's treaty interpretation, the article mainly analyzes the terms of the traditional treaty interpretation theory and the treaty interpretation theory in the Vienna Convention on the Law of treaties, and explains the EU treaty interpretation in good faith. This paper expounds the basic principles of unified interpretation, and points out that the concrete methods of EU treaty interpretation include literal interpretation, historical interpretation, systematic and objective interpretation and comparative interpretation. The third chapter expounds the particularity of EU treaty interpretation on the basis of summing up the first two chapters. The particularity of EU treaty interpretation is also the result of a combination of many factors. Finally, the paper analyzes the important role of EU treaty interpretation in European integration.
