【摘要】：國(guó)際海底資源是21世紀(jì)的接替性資源,也是各國(guó)競(jìng)相參與開(kāi)發(fā)并進(jìn)行爭(zhēng)奪的重要財(cái)產(chǎn),其作為人類(lèi)共同繼承財(cái)產(chǎn)在法理上具有相應(yīng)的依據(jù)。對(duì)其進(jìn)行相應(yīng)的研究,應(yīng)確立人類(lèi)共同繼承財(cái)產(chǎn)的應(yīng)然性架構(gòu),分析國(guó)際海底資源歸屬于全人類(lèi)共同繼承財(cái)產(chǎn)范疇的合理性,研究國(guó)際海底資源作為人類(lèi)共同繼承財(cái)產(chǎn)的現(xiàn)實(shí)距離性,并提出縮小這種距離與切合兩者之間關(guān)聯(lián)的完善思考。
[Abstract]:International seabed resources are the replacement resources in the 21st century, and they are also the important property that all countries compete to develop and compete for. As the common heritage of mankind, the international seabed resources have the corresponding legal basis. In order to study it, we should establish the natural structure of the common heritage of mankind, and analyze the rationality of the international seabed resources belonging to the common inheritance property of all mankind. This paper studies the realistic distance of international seabed resources as the common heritage of human being, and puts forward the perfect thinking of reducing this distance and fitting the relationship between the two.
