【摘要】：雖然一國在海上執(zhí)法時合法使用武力已成為國際習(xí)慣,但濫用武力將嚴(yán)重侵害他國漁民的人身和財產(chǎn)安全。因此,在對他國漁船和漁民使用武力時,需要遵守嚴(yán)格的國際法限制性規(guī)范,符合使用原因、使用程序、使用程度以及國際協(xié)定約束等方面的要求�，F(xiàn)實中,我國漁船和漁民所遭遇的典型事件均是外國非法使用武力所致。對此,我國有必要通過制定判斷標(biāo)準(zhǔn)、依法要求救助和賠償、建立相應(yīng)的保護機制等方式,維護我國公民的合法權(quán)益。
[Abstract]:Although it has become an international custom for a country to use force legally when enforcing the law at sea, the excessive use of force will seriously affect the personal and property safety of fishermen from other countries. Therefore, in the use of force against fishing vessels and fishermen of other countries, it is necessary to abide by strict restrictive norms of international law and comply with the requirements of reasons for use, procedures of use, degree of use and binding of international agreements. In reality, the typical incidents encountered by fishing boats and fishermen in China are caused by illegal use of force by foreign countries. Therefore, it is necessary for our country to protect the legitimate rights and interests of our citizens by making a judgment standard, asking for relief and compensation according to law, and establishing corresponding protection mechanism.
