【摘要】：經(jīng)過(guò)長(zhǎng)期的歷史發(fā)展和國(guó)家實(shí)踐,在國(guó)際法上逐漸形成了內(nèi)容豐富的歷史性權(quán)利規(guī)則。大陸架上的歷史性權(quán)利是歷史性權(quán)利的一項(xiàng)重要內(nèi)容。一國(guó)能否在大陸架上享有歷史性權(quán)利,需要從包括國(guó)際習(xí)慣、《聯(lián)合國(guó)海洋法公約》等條約在內(nèi)的整個(gè)國(guó)際法淵源中進(jìn)行判定,確立大陸架制度的"專(zhuān)屬性固有權(quán)利原則"并不當(dāng)然地就能排斥和否定大陸架上的歷史性權(quán)利。依據(jù)國(guó)際法及其相關(guān)國(guó)家實(shí)踐,大陸架上完全可以融存歷史性權(quán)利。經(jīng)國(guó)家管理或授權(quán)的我國(guó)漁民依靠南�！陡凡尽穼�(dǎo)引,長(zhǎng)期、持續(xù)地在南海大陸架上捕捉馬蹄螺、硨磲等定居種生物的行為,是我國(guó)在南海大陸架上切實(shí)享有歷史性權(quán)利的權(quán)利基礎(chǔ)。
[Abstract]:Through long-term historical development and state practice, historical rules of rights have been gradually formed in international law. The historic right on the continental shelf is an important part of the historic right. Whether a State can enjoy historic rights on the continental shelf needs to be determined from the entire source of international law, including treaties such as international custom, the United Nations Convention on the Law of the Sea, etc., The principle of exclusive inherent rights in the establishment of the system of continental shelf does not automatically exclude and negate the historical rights on the continental shelf. According to international law and relevant state practice, historical rights can be fully incorporated on the continental shelf. China's fishermen, who are under the management or authorization of the state, rely on the guidance of the South China Sea "Gangluo Book" to continuously catch the sedentary species of snails, Tridacas, and other sedentary species on the continental shelf of the South China Sea for a long period of time. It is the right foundation for our country to enjoy the historic rights on the continental shelf of the South China Sea.
