【摘要】：2009年美國眾議院通過的《美國清潔能源與安全法案》規(guī)定,美國有權(quán)對(duì)包括中國在內(nèi)的不實(shí)施碳減排限額國家進(jìn)口產(chǎn)品征收碳關(guān)稅。該法案有關(guān)碳關(guān)稅的規(guī)定違反了《聯(lián)合國氣候變化框架公約》、《京都議定書》及WTO所確立的相關(guān)原則,也不符合WTO的相關(guān)條款。對(duì)此,我國必須在充分利用WTO現(xiàn)有法律機(jī)制的基礎(chǔ)上,制定符合國情的碳稅制度并積極參與國際規(guī)則的制定。
[Abstract]:The U.S. Clean Energy and Security Act, passed by the House of Representatives in 2009, provides that the United States has the right to impose carbon tariffs on imports from countries that do not implement carbon emission reduction limits, including China. The carbon tariff provisions violate the principles established by the United Nations Framework Convention on Climate change, the Kyoto Protocol and the WTO, and are inconsistent with the relevant provisions of the WTO. Therefore, on the basis of making full use of the existing legal mechanism of WTO, our country must establish a carbon tax system in accordance with the national conditions and take an active part in the formulation of international rules.
