【摘要】：非法移民是一個全球性的問題,在中國也存在一定數(shù)量的非法移民。這些非法移民在中國往往會和中國公民共同居住和生活,甚至組成婚姻家庭,盡管這樣的婚姻并不能得到中國現(xiàn)行法律的承認和保護。但是國際法上的婚姻和家庭權(quán)利并不以當(dāng)事人是否具備特定國籍身份為前提條件,因此入境非法移民的婚姻權(quán)利也理所應(yīng)當(dāng)?shù)玫奖Ｗo。本文對我國境內(nèi)非法移民的婚姻問題的成因、現(xiàn)狀以及相關(guān)國際性法律文件進行梳理,希望引發(fā)和推動更多的人對我國境內(nèi)非法移民的婚姻問題進行探索和研究,并促進我國有關(guān)法律法規(guī)的改進和完善。本文內(nèi)容分為六個部分:第一部分是緒論,主要介紹本文的研究意義、研究現(xiàn)狀和研究方法;第二部分是我國入境非法移民及其婚姻概述,將介紹入境非法移民及其婚姻情況分類并分析其成因;第三部分將分析入境非法移民在華締結(jié)婚姻的風(fēng)險;第四部分將分析非法移民婚姻行為對我國的影響;第五部分是有關(guān)非法移民的家庭、婚姻與子女權(quán)利的辨析,并結(jié)合《公民權(quán)利和政治權(quán)利國際公約》以及我國《國家人權(quán)行動計劃(2016-2020)》中關(guān)于此類權(quán)利的規(guī)定進行分析;第六部分是關(guān)于保護入境非法移民婚姻權(quán)益的思考。
[Abstract]:Illegal immigration is a global problem, and there are a certain number of illegal immigrants in China. These illegal immigrants often live and live with Chinese citizens and even form marriage and family in China, even though such marriages are not recognized and protected by China's existing laws. However, marriage and family rights in international law do not presuppose whether the person concerned has a specific national status, so the marriage rights of illegal immigrants should be protected. This article combs the causes, the present situation and the relevant international legal documents of the marriage problem of illegal immigrants in China, hoping to cause and promote more people to explore and study the marriage problem of illegal immigrants in our country. And promote the improvement and perfection of the relevant laws and regulations of our country. The content of this paper is divided into six parts: the first part is the introduction, mainly introduces the research significance, the research present situation and the research method; the second part is our country entry illegal immigration and its marriage summary, The third part will analyze the risk of entering illegal immigrants' marriage in China, the fourth part will analyze the influence of illegal immigrants' marriage behavior on our country. The fifth part is about the family, marriage and children's rights of illegal immigrants, and analyses the provisions of the International Covenant on Civil and political Rights and the National Plan of Action on Human Rights (2016-2020). The sixth part is about the protection of the marriage rights of illegal immigrants.
