【摘要】：從海洋霸權(quán)到大國政治,海權(quán)的權(quán)利轉(zhuǎn)向推動(dòng)了海洋法的發(fā)展。早期的霸權(quán)政治決定了傳統(tǒng)海洋法的國內(nèi)法特性和傳統(tǒng)海權(quán)的權(quán)力屬性。在大國政治和現(xiàn)代國際法的互動(dòng)中,以1982年《聯(lián)合國海洋法公約》為核心的海洋法制度對(duì)國家海洋活動(dòng)的規(guī)范使大國海權(quán)具有權(quán)利屬性。在這種情形下,中國海洋權(quán)利的設(shè)置和構(gòu)建更加依賴于國際軟實(shí)力;在廣義的海洋維權(quán)實(shí)踐中,海洋屬性的基本構(gòu)成為增強(qiáng)這種軟實(shí)力提供了理論分析框架,也有利于中國制定有效的外交路線圖。
[Abstract]:From sea hegemony to great power politics, the power of sea power changed to promote the development of the law of the sea. The early hegemonic politics determined the characteristics of the traditional law of the sea and the power of the traditional sea power. In the interaction between great power politics and modern international law, the law of the sea system, with the 1982 United Nations Convention on the Law of the Sea as the core, makes the maritime power of the great power have the right attribute. In this case, the establishment and construction of China's marine rights depends more on international soft power, and in the broad practice of ocean rights protection, the basic structure of ocean attributes provides a theoretical analysis framework for enhancing this kind of soft power. It also helps China formulate an effective diplomatic roadmap.
