【摘要】：北極海域大陸架劃界問(wèn)題是影響北極區(qū)域法律秩序發(fā)展方向的中心議題。北極海域大陸架劃界問(wèn)題產(chǎn)生法律爭(zhēng)議的根本原因在于,《聯(lián)合國(guó)海洋法公約》體系下有關(guān)大陸架劃界的法律規(guī)則在北極地區(qū)無(wú)條件直接適用,這是北極爭(zhēng)端產(chǎn)生的核心因素,對(duì)北極地區(qū)的地緣政治形勢(shì)和整體法律地位造成全局性的影響。但《公約》有關(guān)200海里外大陸架劃界規(guī)則的全新制度設(shè)計(jì)以及北極區(qū)域的法制架構(gòu)現(xiàn)狀,使北極地區(qū)成為國(guó)際法規(guī)制的一大盲區(qū),客觀上為少數(shù)北極國(guó)家假借《公約》大幅"圈占"北極公地提供了制度上的便利。因此,中國(guó)需要從整體上增強(qiáng)自身在北極事務(wù)中的法律實(shí)踐與應(yīng)對(duì)能力,并抓住北極地區(qū)大陸架問(wèn)題中的重點(diǎn)內(nèi)容,即200海里外大陸架劃界部分確定相應(yīng)的應(yīng)對(duì)策略,多管齊下,維護(hù)自身的北極權(quán)益。
[Abstract]:The delimitation of the continental shelf of the Arctic Sea area is a central issue affecting the development of the legal order in the Arctic region. The fundamental reason for the legal dispute over the delimitation of the continental shelf of the Arctic Sea area lies in the fact that the legal rules governing the delimitation of the continental shelf under the United Nations Convention on the Law of the Sea system are directly and unconditionally applicable in the Arctic region, which is the core element of the Arctic dispute. The overall impact on the geopolitical situation and the overall legal status of the Arctic region. However, the new institutional design of the Convention concerning the rules governing the delimitation of the continental shelf beyond 200 nautical miles, as well as the status of the legal framework in the Arctic region, make the Arctic region a major blind spot in the international legal system, Objectively, it provides institutional convenience for a few Arctic countries to seize Arctic Commons under the guise of the Convention. Therefore, China needs to enhance its legal practice and coping capacity in Arctic affairs as a whole, and grasp the key content of the continental shelf problem in the Arctic region, that is, the delimitation of the continental shelf beyond 200 nautical miles to determine the corresponding coping strategy. Multi-pronged approach to safeguard their own Arctic rights and interests.
