【摘要】：對(duì)于是否應(yīng)當(dāng)構(gòu)建公海保護(hù)區(qū),各國(guó)存在較大分歧。該問(wèn)題的關(guān)鍵在于如何理解公海自由與公海保護(hù)區(qū)的關(guān)系。從理念、內(nèi)容和執(zhí)行層面,兩者的關(guān)系可以解讀為自由秩序與全球治理的關(guān)系、習(xí)慣權(quán)利與條約義務(wù)的關(guān)系以及船旗國(guó)管轄權(quán)與沿海國(guó)管轄權(quán)的關(guān)系。通過(guò)對(duì)這三個(gè)層面的分析可以發(fā)現(xiàn),公海自由與公海保護(hù)區(qū)之間是相互融合、相互促進(jìn)和相互平衡的關(guān)系。這種關(guān)系一方面承認(rèn)公海自由與公海保護(hù)區(qū)之間的確有矛盾,另一方面也表明矛盾發(fā)展的結(jié)果將形成一種公海生物多樣性養(yǎng)護(hù)與可持續(xù)利用的新秩序。如果能夠以發(fā)展的觀點(diǎn)看待兩者關(guān)系中的矛盾,那么就應(yīng)當(dāng)支持公海保護(hù)區(qū)的構(gòu)建。
[Abstract]:There are great differences in whether high seas protected areas should be constructed. The key to this problem is how to understand the relationship between high seas freedom and high seas protected areas. In terms of concept, content and implementation, the relationship between them can be interpreted as the relationship between free order and global governance, the relationship between customary rights and treaty obligations, and the relationship between flag State jurisdiction and coastal State jurisdiction. Through the analysis of these three aspects, it can be found that the relationship between the freedom of the high seas and the protected areas of the high seas is mutual fusion, mutual promotion and mutual balance. On the one hand, the relationship recognizes that there is a contradiction between the freedom of the high seas and the protected areas of the high seas, on the other hand, it also shows that the result of the contradictory development will form a new order for the conservation and sustainable use of biodiversity in the high seas. If the contradiction in the relationship can be viewed from the perspective of development, the construction of protected areas on the high seas should be supported.
