【摘要】：近年來,全球自貿(mào)協(xié)定中對于有關(guān)"監(jiān)管一致性"原則的要求越來越突出,這是全球價(jià)值鏈擴(kuò)展、國際貿(mào)易投資規(guī)則重構(gòu)、國際規(guī)制合作的必然要求。在經(jīng)歷了規(guī)制改革運(yùn)動、WTO良好監(jiān)管實(shí)踐、雙邊和區(qū)域性規(guī)制合作與融合、APEC的規(guī)制合作等階段后,21世紀(jì)的監(jiān)管一致性原則呈現(xiàn)出整體性、操作性、持續(xù)性的特點(diǎn)。中國在參與國際規(guī)制合作的過程中,應(yīng)該重視國際規(guī)則和國內(nèi)規(guī)制間的良性互動、有序設(shè)立監(jiān)管機(jī)構(gòu)和監(jiān)管影響評估,并注意監(jiān)管主權(quán)與承擔(dān)國際義務(wù)間的現(xiàn)實(shí)平衡。
[Abstract]:In recent years, the requirements of the principle of "regulatory consistency" in global free trade agreements are more and more prominent, which is the inevitable requirement of the expansion of global value chain, the reconstruction of international trade and investment rules, and the cooperation of international regulation. After the regulatory reform movement and WTO good supervision practice, bilateral and regional regulatory cooperation and the integration of APEC regulatory cooperation, the principle of regulatory consistency in the 21st century presents the characteristics of integrity, operability and sustainability. In the process of participating in the international regulatory cooperation, China should attach importance to the benign interaction between international rules and domestic regulations, set up regulatory institutions and regulatory impact assessment in an orderly manner, and pay attention to the realistic balance between regulatory sovereignty and international obligations.
