【摘要】：在經(jīng)濟(jì)全球化以及國際金融危機(jī)的影響下,歐盟等紛紛修改其反補(bǔ)貼法,以保護(hù)本國產(chǎn)業(yè),提高本國產(chǎn)業(yè)的國際競爭力,從一定程度上說這將使我國出口產(chǎn)品面臨反補(bǔ)貼措施的高潮。我國對歐盟反補(bǔ)貼制度的研究還處在起步階段,這對從容應(yīng)對歐盟啟動(dòng)的反補(bǔ)貼調(diào)查是極為不利的。因此,對歐盟反補(bǔ)貼制度進(jìn)行深入研究,借鑒國際先進(jìn)經(jīng)驗(yàn)以維護(hù)我國產(chǎn)業(yè)安全,具有重大理論和實(shí)踐意義。 本文分為引言、正文和結(jié)語三大部分,其中正文由四章構(gòu)成。 第一章主要對歐盟反補(bǔ)貼法中的補(bǔ)貼規(guī)則進(jìn)行闡釋。本章首先從歐盟反補(bǔ)貼規(guī)則的歷史演變進(jìn)行分析,接著從法理角度對歐盟反補(bǔ)貼法中的補(bǔ)貼進(jìn)行分析,為下文做鋪墊；然后,從實(shí)證角度對歐盟反補(bǔ)貼法中補(bǔ)貼的定義和構(gòu)成要件進(jìn)行了詳細(xì)論證,重點(diǎn)探討了財(cái)政資助和授予利益的內(nèi)涵。 第二章主要探討歐盟反補(bǔ)貼法中專向性標(biāo)準(zhǔn)界定問題。本章首先闡述了歐盟反補(bǔ)貼法中專向性的定義；接著探析了歐盟反補(bǔ)貼調(diào)查中專向性確定的問題。 第三章主要探討歐盟反補(bǔ)貼法中補(bǔ)貼的分類問題。本章主要從實(shí)證角度對歐盟的可抵消補(bǔ)貼和不可抵消補(bǔ)貼進(jìn)行闡釋。 第四章主要探討歐盟反補(bǔ)貼法中的補(bǔ)貼認(rèn)定規(guī)則對中國的啟示。本章分別從立法、政策調(diào)整、應(yīng)對辦法三個(gè)角度闡述歐盟的相關(guān)規(guī)則對中國的啟示。
[Abstract]:Under the influence of economic globalization and the international financial crisis, the European Union and others have amended their countervailing laws one after another in order to protect their own industries and improve their international competitiveness. To a certain extent, this will make our export products face the climax of anti-subsidy measures. The study of EU countervailing system in China is still in its infancy, which is extremely disadvantageous to the countervailing investigation initiated by EU. Therefore, it is of great theoretical and practical significance to study the countervailing system of EU and to use international advanced experience for reference to safeguard the industrial safety of our country. This paper is divided into three parts: introduction, text and conclusion, in which the text is composed of four chapters. The first chapter mainly explains the subsidy rules in EU countervailing law. This chapter firstly analyzes the historical evolution of EU countervailing rules, and then analyzes the subsidies in EU countervailing law from the angle of legal theory, which lays the groundwork for the following. In this paper, the definition and constituent elements of subsidy in EU countervailing law are discussed in detail, and the connotation of financial aid and conferment of benefits is discussed in detail. The second chapter mainly discusses the definition of specialized standards in EU countervailing law. This chapter first expounds the definition of specialization in EU countervailing law, and then probes into the determination of specialization in EU countervailing investigation. The third chapter mainly discusses the classification of subsidies in EU countervailing law. This chapter mainly from the empirical point of view of the European Union can offset subsidies and non-offset subsidies to explain. Chapter four mainly discusses the enlightenment to China from the rules of subsidy recognition in EU countervailing law. This chapter expounds the enlightenment of EU rules to China from three angles: legislation, policy adjustment and countermeasures.
