【摘要】：政府的承認(rèn)是指當(dāng)國家領(lǐng)土沒有發(fā)生變更,而其政府出現(xiàn)新舊更迭的時(shí)候,所出現(xiàn)的對(duì)政府的承認(rèn)的問題,其與國家承認(rèn)既有區(qū)別又有聯(lián)系。承認(rèn)的性質(zhì)應(yīng)當(dāng)以宣告說為主,而以構(gòu)成說為輔。承認(rèn)奠定建交的基礎(chǔ)、確認(rèn)國家的權(quán)利義務(wù)并撤銷對(duì)舊政府的承認(rèn),承認(rèn)的效果溯及既往,這與"法不溯及既往"的基本原則不相矛盾。有效統(tǒng)治是政府承認(rèn)所適用的首要原則,其中有效控制、穩(wěn)定性和獨(dú)立性是構(gòu)成政府的一般標(biāo)準(zhǔn)和要素。新政府要獲得國際承認(rèn),不僅要實(shí)現(xiàn)有效統(tǒng)治,而且應(yīng)當(dāng)不違反體現(xiàn)在國際條約、國際習(xí)慣和強(qiáng)行法中的國際法基本原則和國際人道主義法。不承認(rèn)的條件僅僅指,國家承擔(dān)了某種不得承認(rèn)某些實(shí)體為國際法主體的條約法上的義務(wù)。
[Abstract]:The recognition of government refers to the problem of recognition of government when there is no change in the territory of the country and when the government changes new and old, which is different from and connected with the recognition of the state. The nature of recognition should be based on proclamation and supplemented by constitution. The recognition of the foundation for the establishment of diplomatic relations, the recognition of the rights and obligations of the State and the revocation of the recognition of the old government, and the retroactive effect of recognition do not contradict the basic principle of "non-retroactivity of law". Effective governance is the primary principle of government recognition, in which effective control, stability and independence are the general criteria and elements that constitute the government. For the new Government to gain international recognition, it must not only achieve effective rule, but also not violate the fundamental principles of international law and international humanitarian law embodied in international treaties, customary international law and jus cogens. The condition of non-recognition simply means that the State has assumed a treaty law obligation not to recognize certain entities as subjects of international law.
