【摘要】：2010年6月29日，大陸與臺(tái)灣在重慶簽署了《海峽兩岸經(jīng)濟(jì)合作框架協(xié)議》（Economic Cooperation Framework Agreement,以下簡(jiǎn)稱ECFA）。ECFA是海峽兩岸根據(jù)世界貿(mào)易組織（World Trade Organization,以下簡(jiǎn)稱WTO）規(guī)則所訂立的一項(xiàng)重要經(jīng)濟(jì)合作協(xié)議，可謂是兩岸經(jīng)貿(mào)關(guān)系正常化的里程碑。本文將在WTO框架下討論ECFA的若干法律問(wèn)題。文章首先回顧了ECFA的簽訂歷程，探討了兩岸簽署ECFA的深層動(dòng)因，并分宗旨與目標(biāo)、貿(mào)易與投資、經(jīng)濟(jì)合作、早期收獲及其他重要條款五個(gè)部分闡述和分析了ECFA的文本內(nèi)容。之后，結(jié)合WTO關(guān)于區(qū)域貿(mào)易協(xié)定的規(guī)則，從程序及實(shí)體兩方面探討ECFA獨(dú)具兩岸特色的條款與WTO區(qū)域規(guī)則的一致性問(wèn)題。本文還通過(guò)分析ECFA在主體及調(diào)整對(duì)象兩方面的雙重性，指出ECFA是部分內(nèi)容受WTO規(guī)則規(guī)范和調(diào)整的一國(guó)國(guó)內(nèi)的特殊法律安排。此外，文章在分析可供ECFA選擇的三種模式各自優(yōu)劣的基礎(chǔ)上，探討ECFA最終選擇以《中國(guó)與東盟全面經(jīng)濟(jì)合作框架協(xié)議》為藍(lán)本的來(lái)龍去脈。最后，文章將ECFA與《內(nèi)地與香港關(guān)于建立更緊密經(jīng)貿(mào)關(guān)系的安排》（Mainland and Hong Kong Closer Economic PartnershipArrangement，以下簡(jiǎn)稱CEPA）進(jìn)行了比較研究，進(jìn)一步闡明ECFA的特點(diǎn)。
[Abstract]:On June 29, 2010, the Mainland and Taiwan signed the Economic Cooperation Framework Agreement (ECFA) in Chongqing. ECFA is an important economic cooperation agreement between the two sides of the Taiwan Strait under the World Trade Organization (WTO) rules. This paper first reviews the signing process of ECFA, discusses the deep-seated motives for the signing of ECFA on both sides of the Strait, and elaborates and analyzes the text of ECFA in five parts: the purpose and objectives, trade and investment, economic cooperation, early harvest and other important clauses. Then, combining with the rules of WTO on regional trade agreements, this paper discusses the consistency between the clauses with cross-strait characteristics of ECFA and the regional rules of WTO from both procedural and substantive aspects. In addition, based on the analysis of the merits and demerits of the three models available for ECFA, this paper discusses the origin and development of the ECFA's final choice based on the framework agreement on comprehensive economic cooperation between China and ASEAN. Closer Economic Partnership Arrangement, hereinafter referred to as CEPA, has made a comparative study to further clarify the characteristics of ECFA.
