【摘要】：中國現(xiàn)有農(nóng)業(yè)補貼反補貼立法存在缺乏農(nóng)業(yè)基本法對補貼的明確支持、與WTO農(nóng)業(yè)補貼規(guī)則的銜接不夠、缺乏農(nóng)業(yè)補貼具體實施制度支撐、農(nóng)業(yè)反補貼立法缺位等問題。同時,隨著農(nóng)產(chǎn)品市場的開放,又面臨著增強農(nóng)業(yè)基礎(chǔ)性地位、重新確定補貼目標(biāo)與補貼動機、應(yīng)對進口農(nóng)產(chǎn)品補貼等現(xiàn)實挑戰(zhàn)。中國農(nóng)業(yè)補貼與反補貼法律制度必須充實農(nóng)業(yè)生產(chǎn)經(jīng)營(服務(wù))主體、明確農(nóng)業(yè)補貼范圍、突出農(nóng)業(yè)補貼重點、強化農(nóng)業(yè)反補貼、完善重要配套制度,以促進農(nóng)業(yè)可持續(xù)發(fā)展和保障農(nóng)業(yè)安全。
[Abstract]:The existing legislation of agricultural subsidy countervailing in China lacks the explicit support of the agricultural basic law to the subsidy, the insufficient connection with the WTO agricultural subsidy rules, the lack of the concrete implementation system support of agricultural subsidy, the absence of agricultural countervailing legislation and so on. At the same time, with the opening of the agricultural products market, it is faced with the challenge of strengthening the basic position of agriculture, redefining the subsidy target and motivation, and dealing with the practical challenges such as the subsidy of imported agricultural products. The legal system of agricultural subsidy and countervailing in China must enrich the main body of agricultural production and operation (service), define the scope of agricultural subsidy, highlight the key points of agricultural subsidy, strengthen agricultural countervailing, and perfect the important supporting system. To promote the sustainable development of agriculture and ensure agricultural security.
