【摘要】：正知識(shí)產(chǎn)權(quán)爭(zhēng)端已成為影響我國(guó)對(duì)外貿(mào)易發(fā)展的重要因素之一。中美知識(shí)產(chǎn)權(quán)爭(zhēng)端的應(yīng)對(duì)將是一場(chǎng)持久戰(zhàn)。應(yīng)對(duì)中美知識(shí)產(chǎn)權(quán)爭(zhēng)端,是中國(guó)從貿(mào)易大國(guó)向貿(mào)易強(qiáng)國(guó)轉(zhuǎn)變過程中的必修課。一、中國(guó)企業(yè)在美國(guó)遭遇知識(shí)產(chǎn)權(quán)爭(zhēng)端情況評(píng)析中國(guó)企業(yè)在美國(guó)遭遇知識(shí)產(chǎn)權(quán)爭(zhēng)端由來(lái)已久,2001年年末中國(guó)加入WTO之后,"301條款"的有效性逐漸弱化,"337條款"成為美國(guó)針對(duì)中國(guó)企業(yè)提起知識(shí)產(chǎn)權(quán)爭(zhēng)端的主打工具。中國(guó)企業(yè)在美國(guó)遭遇知識(shí)
[Abstract]:Intellectual property disputes have become one of the important factors affecting the development of China's foreign trade. The handling of Sino-US intellectual property disputes will be a protracted war. The handling of Sino-US intellectual property disputes is a compulsory course in the process of China's transformation from a trading power to a trading power. Chinese enterprises have been confronted with intellectual property disputes in the United States for a long time. After China joined the WTO at the end of 2001, the validity of "301 clause" has gradually weakened, and "337 clause" has become the main tool for the United States to initiate intellectual property disputes against Chinese enterprises.
