【摘要】：為了提高尚有缺陷的航行自由項(xiàng)目的遵約效力,美國一方面在戰(zhàn)略層次上構(gòu)建全球航行自由行動(dòng)體系(1),利用一切可資利用的資源促進(jìn)別國對(duì)"航行自由規(guī)則"的遵約水平,另一方面通過在全球航行自由行動(dòng)體系中的實(shí)力推進(jìn)和智慧推進(jìn)路徑組建"聯(lián)盟"和簽訂互信協(xié)議等方式重塑航行自由項(xiàng)目的遵約環(huán)境,為美國提供更有利的遵約議價(jià)(2)地位。美國的這一行為方式在南海問題上表現(xiàn)突出,本文試圖對(duì)此加以梳理,更加全面地考察美國對(duì)航行自由權(quán)利的維護(hù),這對(duì)當(dāng)前圍繞航行自由問題與美國不斷發(fā)生海上摩擦的中國的決策具有重要意義。
[Abstract]:In order to improve the effectiveness of compliance with the flawed Freedom of Navigation Project, the United States, on the one hand, builds the Global Freedom of Navigation Action system at the strategic level (1) and uses all available resources to promote compliance with the Freedom of Navigation rules by other countries. On the other hand, the compliance environment of the freedom of navigation project can be rebuilt by means of "alliance" and signing a mutual trust agreement through the power advancing and intelligent advancing path in the global freedom of navigation action system, so as to provide the United States with a more favorable compliance bargaining status (2). This behavior of the United States is outstanding in the South China Sea issue. This paper attempts to sort it out and make a more comprehensive study of the protection of the right to freedom of navigation in the United States. This is of great significance to the current decision of China, which is constantly at sea frictions with the United States over the issue of freedom of navigation.
