【摘要】：信息化和國際化已經(jīng)成為現(xiàn)代社會的發(fā)展趨勢。網(wǎng)絡(luò)的便捷性促使越來越多的消費者進行跨境網(wǎng)絡(luò)購物,隨之而來的消費糾紛也層出不窮。在線糾紛解決機制(ODR)這一新的糾紛解決方式將替代性糾紛解決機制與網(wǎng)絡(luò)技術(shù)的發(fā)展結(jié)合起來,為跨境網(wǎng)絡(luò)購物提供了一種便捷、經(jīng)濟、高效且公平的糾紛解決辦法。本文具體共分為四大部分。第一章通過對跨境網(wǎng)絡(luò)購物在線糾紛解決機制發(fā)展的介紹,引出文章正文。第二章通過對跨境網(wǎng)絡(luò)購物糾紛的概念和特點進行分析,繼而對跨境網(wǎng)絡(luò)購物糾紛在線解決進行說明,闡述了糾紛在線解決的特點及優(yōu)劣勢,為后文提出在線糾紛解決機制的完善方案提供背景知識的支持。緊接著,本文的第三章列舉了在線糾紛解決機制的四種操作模式:在線協(xié)商、在線調(diào)解、在線仲裁、以及購物網(wǎng)站內(nèi)部的糾紛解決機制。全面介紹了在線解決機制在解決跨境網(wǎng)絡(luò)購物糾紛中的現(xiàn)狀、發(fā)展趨勢及存在的問題和挑戰(zhàn),并舉例說明各類典型在線糾紛解決機制的當前實踐情況。本文的最后一章,先對跨境網(wǎng)絡(luò)購物糾紛解決機制的發(fā)展現(xiàn)狀加以介紹,接著在此基礎(chǔ)上總結(jié)出在線糾紛解決機制在技術(shù)標準、法律標準、法律適用、裁決的承認與執(zhí)行方面面臨的發(fā)展困境,最后重點闡述了在線糾紛解決機制在處理跨境網(wǎng)絡(luò)購物糾紛方面的完善方案。毫無疑問,跨境網(wǎng)絡(luò)購物消費的洪流已經(jīng)不可阻擋地沖進了我們的生活,其對于當今消費者的意義,不僅僅是一種新興的購物方式,更是人類消費方式的未來。對于這一必然趨勢的到來,我們要對包括在線糾紛解決機制在內(nèi)的相關(guān)制度加以完善,才能全面適應(yīng)和促進網(wǎng)絡(luò)購物乃至全球網(wǎng)絡(luò)市場的發(fā)展和繁榮。
[Abstract]:Informationization and internationalization have become the development trend of modern society. With the convenience of the Internet, more and more consumers are shopping online, and the following consumer disputes emerge in endlessly. The online dispute resolution mechanism (ODR), a new dispute resolution method, combines the alternative dispute resolution mechanism with the development of network technology, and provides a convenient, economical, efficient and fair dispute resolution method for cross-border online shopping. This paper is divided into four parts. The first chapter introduces the development of online dispute resolution mechanism for cross-border online shopping, leading to the text of the article. The second chapter analyzes the concept and characteristics of cross-border online shopping disputes, then explains the online resolution of cross-border online shopping disputes, expounds the characteristics and advantages and disadvantages of online dispute resolution. It provides the support of background knowledge for the following article to put forward the perfect scheme of online dispute resolution mechanism. Then, the third chapter lists four operating modes of online dispute resolution mechanism: online negotiation, online mediation, online arbitration, and the internal dispute resolution mechanism of shopping websites. This paper introduces the present situation, development trend, existing problems and challenges of online resolution mechanism in solving cross-border online shopping disputes, and gives examples to illustrate the current practice of various typical online dispute resolution mechanisms. In the last chapter of this paper, the author first introduces the current situation of cross-border online shopping dispute resolution mechanism, and then summarizes the online dispute resolution mechanism in the technical standards, legal application, The recognition and implementation of the award are facing difficulties in the development. Finally, the paper focuses on the improvement of online dispute resolution mechanism in cross-border online shopping disputes. There is no doubt that cross-border online shopping has irresistibly rushed into our lives, its significance to consumers today, not only a new way of shopping, but also the future of human consumption. For this inevitable trend, we need to improve the relevant systems, including online dispute resolution mechanism, in order to fully adapt to and promote the development and prosperity of online shopping and even the global network market.
