【摘要】：條約的演化解釋會引起條約語義變化,導(dǎo)致條約權(quán)利和義務(wù)的變動,對傳統(tǒng)的國家同意原則造成沖擊。具體表現(xiàn)在,對締約時的原初意圖進(jìn)行演化解釋,以《維也納條約法公約》第31條解釋要素掩蓋演化解釋中的語義變動,非締約國要素對嗣后行為逐漸產(chǎn)生影響。演化解釋沖擊國家同意原則,其內(nèi)在機(jī)理包括心理因素、實(shí)踐因素和機(jī)制因素。演化解釋一定程度上可推進(jìn)條約體系的自動更新,符合國際秩序自動微調(diào)的現(xiàn)實(shí)需要,逐漸發(fā)展為《維也納條約法公約》解釋通則中,時間要素被強(qiáng)化的一項(xiàng)細(xì)化解釋方法,但也可能沖擊甚至突破國家同意原則。中國需要及時把握條約演化解釋的發(fā)展規(guī)律和深遠(yuǎn)影響并及時作出因應(yīng)。
[Abstract]:The evolution and interpretation of treaties will cause changes in the semantic meaning of treaties, and cause changes in treaty rights and obligations, which will impact on the traditional principle of state consent. In particular, the original intention of contracting is interpreted by evolution, and the semantic changes in evolution are concealed by the elements of interpretation in Article 31 of the Vienna Convention on the Law of treaties, and the factors of non-contracting parties gradually influence subsequent acts. Evolution interprets the principle of shock to state consent, and its intrinsic mechanism includes psychological factors, practical factors and mechanism factors. To a certain extent, evolutionary interpretation can advance the automatic updating of the treaty system, which accords with the practical need of automatic fine-tuning of the international order, and gradually develops into a detailed interpretation method in the general rules of interpretation of the Vienna Convention on the Law of treaties, in which the time element is strengthened. But it may also impact or even break the principle of national consent. China needs to grasp the development law and far-reaching influence of treaty evolution interpretation in time and make timely response.
