【摘要】：近年以來,美國與歐盟等發(fā)達(dá)國家利用TRIPS協(xié)議的彈性規(guī)定,在與其他國家簽訂的自由貿(mào)易協(xié)定中大量加入TRIPS-plus條款。這些條款通過對TRIPS的拓展以及限制來提高知識產(chǎn)權(quán)保護(hù)標(biāo)準(zhǔn),在藥品的專利保護(hù)領(lǐng)域尤為突出。實(shí)踐證明,TRIPS-plus條款嚴(yán)重影響了發(fā)展中國家藥品的可及性。我國作為大量依靠仿制藥品的發(fā)展中國家,在國內(nèi)立法以及簽署自由貿(mào)易區(qū)協(xié)定等國際條約時(shí),應(yīng)當(dāng)對TRIPS-plus條款保持高度警惕,審慎引入專利鏈接制度,為數(shù)據(jù)獨(dú)占保護(hù)設(shè)置限制條件,保留強(qiáng)制許可、平行進(jìn)口等TRIPS允許的彈性條款,盡量為國內(nèi)政策預(yù)留一些選擇空間。
[Abstract]:In recent years, developed countries such as the United States and the European Union have taken advantage of the flexible provisions of TRIPS agreements to add a large number of TRIPS-plus clauses to free trade agreements signed with other countries. These provisions improve the standards of intellectual property protection through the extension and limitation of TRIPS, especially in the field of patent protection of drugs. It has been proved that TRIPS-plus has seriously affected the availability of drugs in developing countries. China, as a developing country that relies heavily on imitation drugs, should be on high alert to the provisions of TRIPS-plus and introduce patent link system prudently in its domestic legislation and signing of international treaties such as free trade zone agreements. It sets restrictions for data exclusive protection, preserves the flexible clauses allowed by TRIPS, such as compulsory license, parallel import, and so on, so as to reserve some choice space for domestic policy as far as possible.
