【摘要】：上海合作組織是第一個(gè)由中國(guó)主導(dǎo)創(chuàng)設(shè)的多邊國(guó)際制度。經(jīng)過(guò)近十年的發(fā)展，上海合作組織已經(jīng)成為維護(hù)中亞地區(qū)和平穩(wěn)定的重要力量。當(dāng)前國(guó)內(nèi)研究上海合作組織的成果主要集中在國(guó)際關(guān)系領(lǐng)域，法學(xué)界鮮有把上海合作組織的安全合作法律機(jī)制作為研究對(duì)象的。本文主要以上海合作組織安全合作法律機(jī)制為切入點(diǎn)，探討了上海合作組織安全合作的依賴(lài)法律基礎(chǔ)，上海合作組織安全合作領(lǐng)域的發(fā)展情況，上海合作組織區(qū)域安全合作法制建設(shè)的現(xiàn)狀分析與存在的問(wèn)題，以及完善措施。本文分為三個(gè)部分： 第一部分：上海合作組織安全合作法律機(jī)理。這部分主要是講區(qū)域安全合作的法律基礎(chǔ)和法律特征，區(qū)域安全合作的國(guó)際法與國(guó)內(nèi)法基礎(chǔ)。重點(diǎn)講述了以"新安全觀"為安全合作的法律理念和安全合作的綜合性分析。 第二部分：上海合作組織區(qū)域安全合作法制建設(shè)的現(xiàn)狀分析與存在的問(wèn)題。本部分首先介紹了上海合作組織安全合作法律機(jī)制的成就，分別從所形成的安全合作法律體系、建立的上海合作組織反恐總機(jī)構(gòu)、聯(lián)合軍演等方面分別作了詳細(xì)的介紹和論述。最后，從安全合作存在的法律機(jī)制和法律問(wèn)題分析，，解析了法律體系不健全、配套立法欠缺，人權(quán)保障缺失，反恐法不完整，刑事司法協(xié)助欠缺等存在的問(wèn)題。 第三部分：本部分是論文的收尾部分，主要講安全合作法律機(jī)制完善對(duì)策。筆者認(rèn)為要完善上海合作組織區(qū)域安全合作，需要樹(shù)立正確的反恐理念，完善有關(guān)法律；調(diào)整合作模式，完善反恐立法。
[Abstract]:The Shanghai Cooperation Organization is the first multilateral international system created by China. After nearly a decade of development, the SCO has become an important force in maintaining peace and stability in Central Asia. At present, the achievements of the domestic research on SCO are mainly focused on the field of international relations, and the legal mechanism of the SCO's security cooperation is seldom regarded as the object of study in the field of law. Based on the legal mechanism of the security cooperation of the Shanghai Cooperation Organization (SCO), this paper discusses the legal basis of the dependence on the security cooperation of the SCO, and the development of the security cooperation of the SCO. This paper analyzes the present situation and existing problems of the legal construction of the regional security cooperation of the Shanghai Cooperation Organization and the measures to improve it. This paper is divided into three parts: the first part: the legal mechanism of SCO security cooperation. This part mainly focuses on the legal basis and characteristics of regional security cooperation, the international and domestic legal basis of regional security cooperation. This paper focuses on the legal concept of security cooperation based on the new security concept and the comprehensive analysis of security cooperation. The second part: the current situation and existing problems of the legal system construction of Shanghai Cooperation Organization Regional Security Cooperation. This part firstly introduces the achievements of the legal mechanism of security cooperation of the Shanghai Cooperation Organization, including the legal system of security cooperation formed, the general anti-terrorist organization of the Shanghai Cooperation Organization, the joint military exercises, and so on. Finally, from the analysis of the legal mechanism and legal problems of security cooperation, this paper analyzes the existing problems such as imperfect legal system, lack of supporting legislation, lack of human rights protection, incomplete anti-terrorism law, lack of criminal judicial assistance and so on. The third part: this part is the end of the paper, mainly on the legal mechanism of security cooperation. The author believes that in order to perfect the regional security cooperation of the Shanghai Cooperation Organization, it is necessary to set up a correct anti-terrorist concept, perfect the relevant laws, adjust the cooperation mode and perfect the anti-terrorism legislation.
