【摘要】：歷史性權(quán)利是個(gè)具有一定抽象性的概念,來源于習(xí)慣國際法,其具體內(nèi)容取決于國家實(shí)踐。《聯(lián)合國海洋法公約》僅涉及歷史性權(quán)利的“冰山一角”,無法取代歷史性權(quán)利在國際法上的作用。歷史性權(quán)利與《聯(lián)合國海洋法公約》權(quán)利既不相互排斥,也無法相互吸收,在國際法上得以兼容。統(tǒng)合海洋法,向世界闡明這一事實(shí)的同時(shí),落實(shí)和保障南海斷續(xù)線內(nèi)歷史性權(quán)利。
[Abstract]:The historic right is a concept of a certain abstract nature, derived from customary international law, the specific content of which depends on State practice. The United Nations Convention on the Law of the Sea deals only with the "tip of the iceberg" of historic rights, There is no substitute for the role of historic rights in international law. The historical rights and the rights of the UN Convention on the Law of the Sea are neither mutually exclusive nor mutually absorbed and compatible in international law. While unifying the law of the sea and clarifying this fact to the world, the historical rights in the intermittent line of the South China Sea are implemented and protected.
