國際藥品貿(mào)易中人權(quán)保護的困境及其解決

【摘要】：國際藥品貿(mào)易中受專利權(quán)保護的藥品價格遠遠超出發(fā)展中國家人民的購買能力,從而侵犯了發(fā)展中國家人民的基本人權(quán)——生命權(quán)和健康權(quán)。TRIPS協(xié)議相關(guān)規(guī)則為實現(xiàn)藥品貿(mào)易中的人權(quán)保護發(fā)揮了一定的積極作用,但仍存在不少缺陷,在完善和創(chuàng)新TRIPS協(xié)議的同時,亦可探索一些新的協(xié)調(diào)之法。
[Abstract]:The prices of drugs protected by patent rights in the international drug trade far exceed the purchasing capacity of people in developing countries. Thus violating the basic human rights of the people of developing countries-the right to life and the right to health. Trips rules have played a positive role in the protection of human rights in the drug trade, but there are still many shortcomings, While perfecting and innovating the TRIPS protocol, we can also explore some new methods of coordination.
