【摘要】：適應(yīng)性管理辦法是國(guó)際海底管理局規(guī)章中新近興起,有助于國(guó)際海底管理局在深海資源勘探和開(kāi)發(fā)過(guò)程中進(jìn)行"魯棒式"決策的重要管理方式。此種環(huán)境管理辦法的重要表征就是"改變",這種表征背后則意味著為承包者增加不可預(yù)測(cè)的風(fēng)險(xiǎn)和負(fù)擔(dān)。中國(guó)是國(guó)際海底活動(dòng)的重要參與者,無(wú)論作為合同承包者還是擔(dān)保國(guó),適應(yīng)性管理辦法是否推行以及如何推行將對(duì)中國(guó)產(chǎn)生切實(shí)而深遠(yuǎn)的影響,應(yīng)對(duì)不當(dāng)將可能使中國(guó)在國(guó)際海底區(qū)域的活動(dòng)中處于被動(dòng)地位,甚至承受不可估量的經(jīng)濟(jì)損失。鑒于此,從適應(yīng)性管理辦法的內(nèi)涵和外延著手,分析國(guó)際海底管理局可能推行適應(yīng)性管理辦法的五種方式,最后提出中國(guó)相應(yīng)的應(yīng)對(duì)方案,使中國(guó)能夠在深海規(guī)則的制定過(guò)程中主動(dòng)參與,成為深海國(guó)際規(guī)則制定的引領(lǐng)者,拓展深海這塊全球治理的"新疆域"。
[Abstract]:Adaptive management practices are emerging in the regulations of the International Seabed Authority (ISA) and contribute to the International Seabed Authority's "robust" decision-making in the exploration and exploitation of deep-sea resources. Risks and burdens. China is an important participant in international seabed activities. Whether or not it is a contractor or a guarantor country, the implementation of adaptive management will have a practical and far-reaching impact on China. Improper response may make China in a passive position in the activities of the international seabed region, or even unbearable. In view of this, from the connotation and denotation of the adaptive management approach, this paper analyzes the five possible ways for the International Seabed Authority to implement the adaptive management approach, and finally puts forward the corresponding countermeasures for China so that China can actively participate in the formulation of deep-sea rules and become a leader in the formulation of deep-sea international rules. To expand the "Xinjiang region" of global governance in the deep sea.
