【摘要】：歐洲逮捕令是在歐盟范圍內(nèi)取代引渡制度而施行的一種逮捕和移交逃犯的國際刑事司法合作新模式。它的理論基礎(chǔ)是相互承認(rèn)原則。歐洲逮捕令是對傳統(tǒng)引渡制度的變革和創(chuàng)新,它取消了本國國民不引渡原則,對特定性原則進(jìn)行限制適用,對嚴(yán)重犯罪取消雙重犯罪原則,在程序上更為簡化快捷。它對我國建立便捷高效的區(qū)際移交逃犯制度具有很好的啟示作用。
[Abstract]:The European arrest warrant is a new mode of international criminal judicial cooperation to arrest and surrender fugitives. Its theoretical basis is the principle of mutual recognition. The European arrest warrant is a reform and innovation of the traditional extradition system. It cancels the principle of non-extradition of nationals, limits the application of the principle of specificity, and cancels the principle of double criminality for serious crimes, which simplifies the procedure more quickly. It has a good enlightening effect on the establishment of a convenient and efficient inter-regional rendition system in China.
