商業(yè)賄賂犯罪的立法思考

【摘要】:商業(yè)賄賂犯罪并不是一個(gè)刑法意義上的概念,我國現(xiàn)行刑法并沒有對(duì)賄賂犯罪進(jìn)行類似美國刑法“公務(wù)員賄賂罪”和“商業(yè)賄賂罪”的區(qū)分,所以導(dǎo)致目前我國學(xué)界和實(shí)務(wù)部門對(duì)商業(yè)賄賂犯罪范圍的認(rèn)識(shí)并不統(tǒng)一。商業(yè)賄賂犯罪中最主要的犯罪行為就是商業(yè)行賄罪和商業(yè)受賄犯罪。相比國外的規(guī)定,目前我國面對(duì)商業(yè)賄賂犯罪最主要的問題有:《聯(lián)合國反腐敗公約》(以下簡(jiǎn)稱《公約》)將行賄罪和受賄罪都統(tǒng)一規(guī)定在“賄賂本國公職人員”條文中。對(duì)照我國刑法相關(guān)規(guī)定我們可以發(fā)現(xiàn),公約并未將“為謀取不正當(dāng)利益”和“為他人謀利益”作為行賄和受賄犯罪的構(gòu)成要件,《公約》未將“數(shù)額較大”作為商業(yè)賄賂犯罪的構(gòu)成要件,但是我國刑法對(duì)賄賂犯罪無一例外的規(guī)定了“數(shù)額較大”作為構(gòu)成要件,我國現(xiàn)行刑法規(guī)定的賄賂的范圍過窄,還有行賄行為方式上我國刑法只規(guī)定了“實(shí)際給予”而《公約》規(guī)定的行賄方式為“許諾給予”、“提議給予”、“實(shí)際給予”。目前學(xué)術(shù)界關(guān)于商業(yè)賄賂犯罪的立法模式的選擇有以下幾種:第一種是采用單行刑法模式制定統(tǒng)一的《反商業(yè)賄賂法》,第二種采用附屬刑法的立法模式,第三種觀點(diǎn)則是在《刑法》中設(shè)立單獨(dú)的商業(yè)賄賂犯罪條款,第四種觀點(diǎn)刑法修正案對(duì)現(xiàn)行罪名進(jìn)行修改和補(bǔ)充。從四種觀點(diǎn)進(jìn)行分析對(duì)比來看,各有利弊,筆者基于第四種觀點(diǎn),認(rèn)為對(duì)于商業(yè)賄賂犯罪的立法完善,應(yīng)當(dāng)采用刑法修正案為主,單行刑法為補(bǔ)充的立法模式,但是首先在程序上應(yīng)該給予人大委員會(huì)修改刑法的正當(dāng)性。
[Abstract]:The crime of commercial bribery is not a concept in the sense of criminal law. The current criminal law of our country does not distinguish the crime of bribery from that of "civil servant bribery" and "commercial bribery" in American criminal law. Therefore, the current understanding of the scope of commercial bribery crime is not uniform in academic circles and practical departments in our country. The most important crime of commercial bribery is the crime of commercial bribery and the crime of commercial bribery. Compared with the provisions of foreign countries, the most important problems facing the commercial bribery crime in our country at present are: the United Nations Convention against Corruption (hereinafter referred to as the Convention) unified the bribery crime and the bribery crime in the provision of "bribery of national public officials". In contrast to the relevant provisions of our criminal law, we can find that, The Convention does not take "for the purpose of obtaining improper interests" and "for the benefit of others" as the constituent elements of the crime of bribery and bribery, and the Convention does not regard "large amount" as the constitutive element of the crime of commercial bribery. However, the criminal law of our country, without exception, stipulates that the amount of bribery is relatively large, and the scope of bribery stipulated in the present criminal law of our country is too narrow. The criminal law of our country only stipulates "actual giving" and "promise giving", "proposing giving", "actual giving". At present, the choice of the legislative model of commercial bribery crime in academic circles is as follows: the first is to adopt a single criminal law model to formulate a unified Anti-Commercial bribery Law, and the second is to adopt the legislative model of subsidiary criminal law. The third view is to establish a separate criminal clause of commercial bribery in the Criminal Law, and the fourth is the amendment of the Criminal Law to amend and supplement the existing crimes. The author, based on the fourth point of view, thinks that the legislative perfection of commercial bribery crime should be based on the legislative model of the amendment of criminal law, which is supplemented by single criminal law. But first of all, the procedure should be given to the NPC Committee to amend the legitimacy of the criminal law.
