【摘要】：國際貿(mào)易與人權(quán)的關(guān)系問題由來已久,早在古羅馬時代的奴隸制度下,奴隸貿(mào)易的開展就體現(xiàn)了貿(mào)易發(fā)展和人權(quán)保護(hù)之間的沖突。第二次世界大戰(zhàn)之后國際人權(quán)與貿(mào)易發(fā)展分別進(jìn)入制度性階段,其主要代表機(jī)制分別是二戰(zhàn)后建立的聯(lián)合國體制和關(guān)稅與貿(mào)易總協(xié)定。在全球化的背景下,GATT發(fā)展成為WTO多邊貿(mào)易體制。憑借強(qiáng)有力的爭端解決機(jī)制和多邊談判的方式,國際貿(mào)易在WTO多邊體制下獲得了長足的發(fā)展,其與國際人權(quán)體制下的人權(quán)保護(hù)之間的沖突也日益明顯。如何協(xié)調(diào)兩者之間的關(guān)系問題,在國際社會受到廣泛關(guān)注。加入世界貿(mào)易組織十年的時間里,我國已經(jīng)發(fā)展成為主要的世界貿(mào)易大國,然而長期以來也是人權(quán)貿(mào)易措施濫用行為的受害者,研究國際貿(mào)易與人權(quán)之間的關(guān)系對于我國對外貿(mào)易與人權(quán)的發(fā)展具有現(xiàn)實(shí)意義。 本文主要分為五個部分: 第一章考察了貿(mào)易和人權(quán)關(guān)系的歷史,分析早年違反人權(quán)的貿(mào)易做法,介紹19世紀(jì)借助貿(mào)易手段廢除奴隸制和奴隸買賣的經(jīng)驗(yàn),以及導(dǎo)致第二次世界大戰(zhàn)爆發(fā)的經(jīng)濟(jì)和貿(mào)易因素;闡述國際貿(mào)易與人權(quán)之間沖突的歷史,協(xié)調(diào)的嘗試及對當(dāng)代的啟示。 第二章主要介紹了國際貿(mào)易與人權(quán)之間的鏈接。此部分詳細(xì)介紹了兩者之間的價值鏈接——自由;人權(quán)在GATT/WTO體系中的地位;進(jìn)而指出影響貿(mào)易發(fā)展的四個主要的人權(quán)規(guī)則,即健康權(quán)、勞工權(quán)、環(huán)境權(quán)和發(fā)展權(quán)。 第三章論述貿(mào)易規(guī)則與人權(quán)規(guī)則在直接目標(biāo)、法律制定的過程與方式、權(quán)利與義務(wù)的內(nèi)容以及執(zhí)行與實(shí)施的機(jī)制四個方面的差異,進(jìn)而探究制度差異的內(nèi)在沖突本性、制度沖突的外在表現(xiàn)、制度性沖突的影響等。 第四章分析西方學(xué)者有關(guān)調(diào)和貿(mào)易與人權(quán)沖突的傳統(tǒng)理論(如效率優(yōu)先論、人權(quán)優(yōu)先論、例外平衡論和WTO立憲論)。探討人權(quán)規(guī)則與WTO規(guī)則的位階、人權(quán)規(guī)則有無強(qiáng)行法屬性,提出了協(xié)調(diào)國際貿(mào)易與人權(quán)之間沖突的方法。 第五章介紹了我國對外貿(mào)易與人權(quán)發(fā)展的概況,以及在發(fā)展過程中所遇到的問題,最后指出相應(yīng)的對策和建議。
[Abstract]:The relationship between international trade and human rights has a long history. As early as the ancient Roman era of slavery, the development of the slave trade reflected the conflict between the development of trade and the protection of human rights. After the second World War, the development of international human rights and trade entered into the institutional stage respectively, its main representative mechanism was the United Nations system and the General Agreement on tariffs and Trade established after the second World War. Under the background of globalization, GATT has developed into the multilateral trading system of WTO. With the help of strong dispute settlement mechanism and multilateral negotiation, international trade has made great progress under the multilateral system of WTO, and the conflict between international trade and the protection of human rights under the international human rights system is becoming increasingly obvious. How to coordinate the relationship between the two has received extensive attention in the international community. In the ten years of China's accession to the World Trade Organization (WTO), China has developed into a major trading power in the world. However, it has long been a victim of abuse of human rights trade measures. The study of the relationship between international trade and human rights is of practical significance to the development of China's foreign trade and human rights. This paper is divided into five parts: the first chapter examines the history of the relationship between trade and human rights, analyzes the trade practices that violated human rights in the early years, and introduces the experiences of abolishing slavery and the slave trade by means of trade in the 19th century. And the economic and trade factors that led to the outbreak of the second World War, the history of the conflict between international trade and human rights, the attempt of coordination and the enlightenment to the present. The second chapter mainly introduces the link between international trade and human rights. This part introduces in detail the value link between them-freedom, the status of human rights in the GATT/WTO system, and then points out the four main human rights rules that affect the development of trade, namely, the right to health, the right to labor, the right to environment and the right to development. The third chapter discusses the differences between trade rules and human rights rules in four aspects: the direct goal, the process and way of making laws, the content of rights and obligations, and the mechanism of enforcement and enforcement, and then probes into the inherent conflict nature of institutional differences. The external manifestation of institutional conflict, the influence of institutional conflict and so on. The fourth chapter analyzes the traditional theories of Western scholars on reconciling trade and human rights conflict (such as efficiency priority, human rights priority, exception balance and WTO constitutionalism). This paper probes into the rank of human rights rules and WTO rules, whether human rights rules have the attribute of jus cogens, and puts forward a method to coordinate the conflicts between international trade and human rights. Chapter five introduces the general situation of the development of foreign trade and human rights in China, and the problems encountered in the process of development, and finally points out the corresponding countermeasures and suggestions.
